Is it allowed?

Completely residential area, kids settled in bed and he comes driving up & down tooting his horn for business at 8pm - is he allowed to do that?

Does he need a permit or anything to trade here? Anyone know the regs?

Looking at the van, I would say that comes with a side order of salmonella on the house...!

I might be talking rubbish here but I thought with regarding to hooting ya horn, its suggested not to do it after either 10 or 11pm....like I say might be me just getting me wires crossed.

Cod and Chips twice please.. one pickled egg... NO mushy peas... that's for Northerners only.

You MUST NOT use your horn while stationary on the road or when driving in a built up area between the hours of 11.30 pm and 7.00 am.

blimey though, didnt realise they still had moby chip shop vans, used to love them as a kid.

I think you cant toot in a built up area

I know that's for a normal car horn, but not someone continuously tooting going up & down the road ... kids have now been wrestled back into bed anyway!

wish we had a mobile chippy

I've never heard of a mobile fish & chip van.

go out and batter him

Now,admittedly,I dont drive but I always believed you couldnt toot the horn at ANY time unless its to warn other drivers of impending danger?

I could send him over but looking at the state of the van... maybe not!

The horn. Use only while your vehicle is moving and you need to warn other road users of your presence. Never sound your horn aggressively. You MUST NOT use your horn
while stationary on the road
when driving in a built-up area between the hours of 11.30 pm and 7.00 am
except when another road user poses a danger.

So the short answer is 'No' he is not allowed to do that.

OK well he was still moving at the time and it's before 11.30 - darn, I guess he's allowed then! Don't know if he needs a permit or anything to trade here do you?

No read it again, he isn't allowed to do it. He isn't warning other road users, he is touting for business.

go and give him some advice...he is not allowed to toot his horn...so go and buy an ice cream van!

Just looking on google and lots of councils have codes of practise for use of horns/bells etc for vans that sell in streets. I would phone them up tomorrow and get their guidelines. They are quite strict for ice cream vans so cannot imagine why they would not be for this seller.

How long does this "tooting" last?

Brilliant - thanks!

Dunno, maybe a bit longer in bursts on & off... long enough to get the kids up is the problem ... if it had been at 5pm I wouldn't care ...

and it's tooting broadway, what a coincedence. I though you meant tooting in your title, but think you meant tooting his horn

nope, it is a fixed penalty £30 fine for misuse of an audible warning instrument. Words of advice would probably be best, unless we got loads of complaints

I didn't quite know what else to call it:oops: - yours was funny though (& look how young he looks!)

i remember as a nipper the "pie&pea man"
he used to drive ringing a bell, we used to take out our own dish and he'd fill it up ;-)

Have a diplomatic word in his ear.

If it is 8pm as you say, residents will know when he is arriving so no need to alert them.
