They have refused to return the handset cos it has been used for aprox 5 mins, argh what now?

Stick it on the For Sale or Trade forum perhaps...

You have a seven day cooling off period for many items purchased remotely - I don't know if the Sale of Goods Act specifically excludes mobiles?

When I got mine with Orange Business I had 14 days to return it if I didn't like it - but that was for an exchange, not a refund.

Do you want to give more details about why you wish to return it?

I don't understand this. I'm sure you have a 7 day cooling off period under the DSR. Why won't they accept it? Unless you using it for 5 minutes invalidated this.
I would contact your local trading standards and get some professional advise.

Acceptable condition means the handset should be in unused good clean condition and complete with all parts & accessories in its original packaging''

So did i or did i not get 7 days peace of mind guarantee?

This simply means that they don't want you to post the phone back to thme without first getting permission - you have to get a code from them to post with the phone so that they know who it has come from. This is standard practice with online sales.

The fact that it states unused means that you have lost your right to return it - very unfair in my view but they are the terms and conditions you have agreed to.
