just seen the thread and the only piece of advice I'd give is wait until a proper mod intervenes. Namely ascottishbloke, as its pretty obvious from the last mod reply in the thread that andywedge hasnt a clue whats going on.

neither has ascottishbloke really, all he has said is you should take the hit on posting it back to get your refund, which is rubbish, you should get your refund first and the cost of posting it back if the OP wants it. I mean its not for the mods to sort out really anyway but that is a useless comment tbh

It's not as useless as the nonsense andywedge came up with. for some reason he doesn't think the op has even recieved the perfume yet. mental.

to be fair he has offered a refund upon receipt and seeing that he is a long standing member/good feedback I highly doubt he will scam £46 quid off you.

Yes the legitimacy of the item is in question but thats something for the mods to sort out whether there is a lock on fs/ft account.

You shouldn't post it at all really; whilst I don't think its strictly illegal to post counterfeit goods in the UK (although it should be...), you have no idea what the actual composition of the 'perfume' is. You are not allowed to send flammable goods or chemicals with >70% ABV through the post, plus a lot of other chemicals are banned - so without any idea of what the 'perfume' is it shouldn't be posted.

I'd send pictures to Chanel, and perhaps also got to a recognised retailer of the perfume, and try and get written confirmation that they agree it is counterfeit; if they can provide this, the seller should refund in full and the product should be destroyed. Tough luck on the seller perhaps, but what else are they going to do with it?

Sell it to someone else who is less suspecting I expect!

    Item could have been switched.

Selling was adamant item was authentic. After jumping through all the hoops he requested. Hr confirmed he agreed it was fake. So this point is resolved.I don't want to be out of pocket with postage.Although seller has good feedbaxk, there are a few things I don't like:2. Suspicious as to why a man got woman's perfume as a gift

    Maybe he's gay?

Drag Queen? uses the perfume at weekends ( no offence intended to RC or anyone else)

It might also be his wife's.

I do like men's fragance though more than women's.

That took some reading. Personally i think the Seller knew it was fake........they kept saying it was a gift to them but who buys a bloke perfume. oO Not only that but they have asked the person where they bought it from...........must have been awkward explaining why you are selling your 'gift'.

After the way the seller has tried to wriggle out of it then i hope that the mods review once it's all settled to see if further trade restrictions should be placed on them.

    Also........remember to neg ericagradus.

its actually illegal to knowingly send counterfeit goods like that in the post, you should stand your ground and just demand a refund and get rid of the perfume.

threaten to take the op to small claims court.

I'll deal with the dispute on the actual thread, although will comment here regarding my thoughts in general (not trade specific)

I thought it was too but its seems it isn't (well, I can't find anything that explicitly states it is). But as said above, without any idea what the perfume actually is, it might be prohibited to send anyway...

It seems like Ricardo K is pretty genuine especially with the high amount of pos feedbacy and has just been duped himself when receiving the product, however if I was in his shoes I would offer a full refund and either ditch the product, or pay for it to be returned to me if I wanted it.

I'm sure ASB is aware as he's very thorough and no doubt he's checking this page as well. Plus it's about 1pm where he is at the mo so he should still be fresh as a daisy

I cannot reply to your post on FS thread.

I am disappointed that you say that I should pay recorded delivery to return a counterfeit item.

But more importantly you haven't confirmed that the Seller should refund me and that I should post on receipt of funds.

doesn't actually say anything about counterfeit items, only currencies I think its a myth tbh (plus Ive done it haha)

If a seller is willing to refund prior to receipt of the item, then that's a credit to them. We won't be making any direction to refund, that's between the buyer/seller.

If we notice any sort of issues with a particular seller and/or there's a previous dispute which remains unresolved, we'd action further

You could always follow the advice of jah128 if you want to take this further, however when an OP offers to refund the full purchase price we'll not be taking any further action.

You do of course have the right to pursue independently for your additional return postage charge. Some sellers here might have offered that as a matter of routine and highlighting their good service/feedback, but that's between buyer/seller again.

Think its illegal in US Mail and perhaps Ebay follow this trend on. Still, its a fair point to say you shouldn't really send a chemical which is unknown, unidentified and known to not be what it suggests it is through the post regardless...

might be illegal but as far as im aware there are no checks for CONUS mail which is similar to here, not really gonna question packages unless they have wire out of them and ticking Have had stuff sent to there and back and never been stung/caught lol

counterfeit goods are illegal full stop, i dont think you need royal mail to confirm that illegal goods shouldnt be sent through the mail.

i think a couple of you are getting confused with paypals terms & conditions.

your main problem is getting confirmation from a credible source that the goods are actually counterfiet

I have to say the way you have been treated is pretty diabolical ,For the seller to say the item is definitely genuine when the seller does not know where the item came from is nothing short of a joke,I dont understand why the mods are siding with the seller on this as they are usually quite good at making sure that these things dont happen on here, The listing really should have been pulled in the first place as this is a regularly counterfeited item and the seller had no proof of its authenticity,

nonsense its not upto the mods to start acting like customs and excise or the police

so now you reckon every item sold here should have a certificate of authenticity.....lmao

Perhaps take the item to a local department store (or similar store that has a perfumery counter) that sells the genuine item & take photographs with a sales leaflet/business card or some other form of identifying document side-by-side with the alleged fake item.

The counter staff may well be able to advise how to contact Chanel, or may do this on the buyer's behalf.

They may also like to know the details of the seller.

I am willing to throw a couple of quid your way, ericagradus, to help you post this back to the seller.

If enough of us do the same then you'll have your "refund" & your can report the matter to the police without having to return it.

    BFN,

    fp.

    PS. On a related note...

I hope this helps as advice for all regarding selling items of significant value; take photographs prior to despatch (with your user name & the current date) so that if a claim is made you can demonstrate the condition of the item you sold/sent.

Obviously it is not substantial proof that it was the item you sent, but it may help resolve issues (like this) in a more expedient manner.
