    One Stop Phone Shop Stole £300 from me.

    about 6 years ago or whenever the samsung d500 first came out i got a contract with one stop i also took out insurance i kept the phone for 12 months and canceled the contract my dad paid my bill then and when he was looking at his monthly statement he wondered what that payment was for he inquired from his bank and they told him it was one stop , he rang them and they said that cost is for insurance you canceled the contract but you didn't cancel the insurance and then she said you can transfer it no any phone, WTF?? if i take a contract out with voda and cancel my contract if i have insurance its canceled to, so they have taken £5 every month for about 5 years , can i claim it all back??

    I dont think so, its your responsibility to cancel it.

    I know my insurance for my phone when I was on contract with Orange was not with the phone company but dealt with with another insurance company -set up by Orange and reccomended by Orange.
    They may have explained it to you back then - but guessing this is too far back for you to remember?
    I don't think your be able to claim it back - but not an expert - sure some one will be around shortly to answer that for you

    Thats terrible, I cant believe they have billed you! I would assume when you cancel a contract that came with insurance, the insurance is cancelled aswell.

    The insurance is completely separate to the phone (i.e. you signed up to 2 contracts). It's up to you to cancel both - after all, if you had changed your mind about the insurance & cancelled just the insurance would you have expected the company to cancel your phone contract as well?

    You could speak nicely to the insurance company and ask for a goodwill payment (speak to a manager), otherwise it's a lesson learned.

    If so, and you can't get the money back, can you not now claim to have "lost" or "broken" the phone that is insured (even though it's 6 years old)? Meaning you might at least get a new phone for your £300? ;-)

    You would assume - and there is your problem. Even if they put separate cancellations in the T&Cs solely to trap people like this, it is still legal.

    You already had the insurance even if you didn't need or know about it - so I would hold little hope of getting it back.

    Plus, I know some people don't check their statements in detail, but 6 years?

    Likely the terms cover the phone like for like - so you would get the current value of that model (i.e. not much) not the £300 you paid in premiums.

    That and the small matter of insurance fraud.

    Orange did to my ex - realised one month after he cancelled his phone the company they used for insurance took payment.

    Hence - never assume anything - if in doubt - check.

    you should have just told them that you dont want the free insurance in the first place....waste of time in my eyes - home insurance will cover most things anyway!

    I wonder if the OP knows that the D500 was released late 2004, so them having one in 2001 is... well hard to believe? :thinking:

    Also, OSPS only pass on the details to an insurance company, so OSPS have not 'Stole' a penny. :thinking:

    I wonder if the OP used their dad's account because they're not responsible enough to run a current account? :thinking:

    There's a lot of difference between 3 years and 6. It halves the amount 'Stolen' for one.

    If you and your dad didn't read the t's & c's then why are you stating that they 'stole' from you? :?

    Lots don't read the t's& c's, they often land on here and MSE looking for a way out of the mess they could've avoided if they stopped and thought before they got their 'Shiny new phone'. :thumbsup:
