    Opinions on eBay problem...

    first off, i know alot of people will just come to troll. but if you mind not doing so would be helpful....

    I bought a ps3 off ebay, that was being listed as faulty, but here's the issue bit.
    I clearly messaged the seller and he said replacing the hard drive will fix it, and there was no other issue listed with it.
    Took a while to get it, about 2 weeks but finally got it recently. Replaced the hard drive today, turns on, i'm thinking all is well.
    I try to test a game, none of them are reading (the drive doesn't even sound like it's running)..... look online to find it's a common issue with ps3's...
    So I contacted the seller and he tells me now, that the hard drive problem was 'advice' from a person who fixes ps3's and that's what he was selling it on, and did not know it doesn't read discs.
    I accept the item was listed as faulty, and I went ahead to buy it, but the problem is the real fault wasn't listed, and had I known (or apparently him too) I would never have bothered! I'm out of money for the PS3, and buying a new hard drive to replace it!

    So, what would you do in this situation?
    Am I entirely in the wrong?

    Reselling would barely get half the price as the new issue means no-one can play games, which is why I paid a bit more for his listing as I expected to be able to once I replaced the drive!

    you put 'should' work which means it may but it's not certain, you should have said 100% work or worded it differently, i don't think you will have much luck with a refund mate

    I feel like just adding the unit is not A1 condition lol. it has loads of scratches and visibly looks used. More like B3/C3

    ahh I see.
    But i dont know if i explained it in the OP but the seller was also under the impression from his ps3 fixer's 'advice' that this was the only problem and it would work if replaced. So I don't really know who's wrong as I guess we was both misled, him into selling it and me from his knowledge being wrong.

    From the listing I'd assume he meant the optical drive.

    paypal will refund you. They are actually good for this sort of thing, even though I do think buyers abuse paypals leniency towards buyers in alot of cases. In this instance your in the right for the console purchase.

    No legs to stand on with regards to purchasing a new internal hard drive though.

    the personson said the problem was with the hard drive,didi he say the item was opened or tried to be fixed if not and item was opened and mucked around with take a ebay protection against him if the problem was more than what he said (he probilly new as was trying to get a bit more cash for) have dealed with ps3 on ebay for a while and they are more than just simple problems than hard drive

    He clearly said the console had not been opened, and the warranty sticker was still in tact, which is true.
    I believe that from contacting them, and do believe that it's just we both never knew the real issue..

    With PS3's the hard drive replacing doesn't void the warranty, the seal is still intact as it's a slot for owners to upgrade.
    So I haven't broken any warranty seal or 'opened' up the item so to speak.

    You purchased a faulty non working ps3 and you received a faulty non working ps3.

    To me it seems that the you and seller is confused by the technical language. As he states that the ps3 has a

    . Which he doesn't specify if it is a dodgy optical drive ( which it is) or a hard drive failure. For some reason you have assumed it is a hard drive and the seller has got this confused this with the optical drive.

    Yeah I think this is what has happend too.
    But I clearly asked about the hard drive and replacing it, and his answer made me assume that.

    TBH I could see how it is neither of our faults, more a misunderstanding in communication.. which is why I have refrained from leaving him negative feedback.

    I read it as optical drive.

    I very much doubt anyone would be selling a ps3 if it was just the harddrive that was busted seeing as you can remove them very easily and plonk a new one in.

    If you paid by Credit Card ask to do a chargeback for SNAD which paypal will probably not even dispute. May cost you to return the item by a recorded method but you should get most of your funds back.

    Going to ask the seller what they want to do, else I will jut relist i and hope it goes for at least a similar price...

    Am I right on thinking that the ps3 still 'works' and will play media from usb, psn downloads (on hard drive), play tv and allow streaming via wireless? It is just the optical drive that doesnt work? - i.e ps3 retail, bluray, dvd etc?

    If so, I might look into getting a faulty ps3 for the gf (Want to sell the one you dont want on to me?!), she loves playing lumines and other psn puzzle games on mine plus the media I have stored on the internal and external HD's.

    Would agree there Phil - its not SNAD

    Sold as spares or repair, this is the risk you take IMO. Assuming the price was reasonable I would just write it off and break for spares.

    The problem is that the seller specifically listed a fault. You could argue you bought the part to repair the fault mentioned but then under discovery there was found to be further faults which the seller had failed to mention.The seller has probably tripped themselves up by mentioning one fault knowing it would fetch more than if he liasted all the problems. The seller should have covered them selves by stating it could have further problems or when asked the question they should have mentioned that replacing the drive is not guarenteed to get the item working. This is one of the reason that i always pay for items on Paypal with a credit Card now so you have two levels of protection if a paypal appeal fails. You normally find the credit cards are not as strict when it comes to SNAD items and once the chargeback has been made paypal state they will challenge a SNAD.

    I would definarely raise a paypal claim since it is not going to affect you in anyway and the seller cannot even neg you if you do. All they can do is block you from bidding in future auctions off them and you are hardly gonna buy from them in the future anyway.

    I'm sorry if i sound cold and calculated but Ebay just ain't for the faint harted anymore as a seller you've got to be so precise when you describe or you are just leaving yourself wide open. Looking at the seller i don't think there is any intention in misleading the buyer just more like inexperience of selling on Ebay thats not much comfort for the buyer. Simple and honest answers when asked about the hard drive like te ones given afetr the sale would have solved any problem but then he would have probably got less money for it.

    Someone i know listed a laptop with a battery fault it turned out to be the charging circuit and not the battery, they refunded the laptop costs as well as the battery now thats a good seller. Doubt this seller will refund the Hard drive which the buyer is now out of pocket.

    Sorry, forgive me.
    I had forgotten the specific question about the hard drive.

    It is a tricky one.
    The listing clearly doesn't mention which drive it is, but subsequent questions do.
    It could be that the seller doesn't understand the difference between hard drive and optical drive.
    Probably your average PS3 user may not even know what these items are anyway.
    It is a difficult call but having looked again and seen the specific question, I would possibly side with the OP.

    You'd have to state your price though, with the 250gb internal and without, as I already have a few spare hard drives I'm not in desperate need for 250gb.

    Lesson for the future,don't purchase anything on the basis of a reply to a query that isn't listed on the auction such as this.

    just to let everyone know, put in a claim and paypal sided with me, so I should get a refund once I ship it back to the seller.
