Hi Guys
Need advice pls I parked in a shopping car park a week ago. I overstayed the permitted time by approx half hour and now have received a fine, asked to pay 50 pounds. Is there any way that I can avoid that, it has been sent by Parklingeye. Thanks guys

Ignore it. Seriously - you haven't committed a crime and they cannot impose a fine on you. Do not reply via any means.

I wouldn't worry about that though, I think they're either hoping to scare people into paying without defending the case, or their solicitors just got out of law school with a third and are trying to flex their muscles in the legal world.

No court would ever prosecute someone for this - the precedent it would set would be dangerous. The important fact is that they cannot prove who was driving the car at the time.

Edit - if you read that thread fully, there are suggestions it is a fake case.

correct its merely an "invoice" disguised as a formal legal fine.

had one of these at xmas , ignored it, nothing happened. though i am following that case the previous poster linked closesly, very interesting to see what happens but i feel it will be dropped.

sorry to bore you again. I received tow more notices , first one with photos of my car and other one today. The latest is very threatening in language, with suggestions that they will rope in debt colection ageencuy and CCJ involvement etc...what do you say guys. they have increased the fine up from 50 to 80 pounds and suggested it will go up to 110.

They do it all the time to scare people into paying. Only thing you need to worry about is genuine court papers, which they are highly unlikely to issue. They cannot issue a CCJ without taking you to court, them winning, and you refusing to pay. The CCJ threat is little more than hot air.

Keep ignoring them, they will go away eventually.

Stand strong and don't be intimidated. They won't take it to court, all they have are letters and threatening language.

The same tactics were used by law firm ACS:Law to scare people into paying fines for downloading music 'illegally'. They're now in trouble with the Solicitors Regulation Authority for their shady practises.

If one of these companies took someone to court, they would fail and then their whole business would collapse.

so they have a picture of a car thats "similar" to yours .. remind me were you not visiting elsewhere at the time they say you were overstaying at some car park that you have never been in :D..

Keep your nerve, & don't pay up. Regardless of what they say, the onus is on THEM to prove that you owe them money, which they can only do by taking you to court and winning.

If everyone didnt pay, they couldnt run a business then would be gone.....sorted!!!!

Just ignore the letters and they stop. I park in their car parks all the time and there is nothing they can do about it. I put the letters through my shredder soon as I get them now.

Update: It was only day before yesterday that I had received another notice from Parkingeye. Today I received a phone call with pre-recorded message. I used 1471 service to check who had called, after checking on google the number belongs to some Macmillan debt collection compnay.
Could it be that parking eye may have already passed my details on to deebt collection company, they had threatend to use bailiffs in the last letter.. Please guide. Thanks

Post up all the info you have on the debt collection company. They've most likely got no authority to take money from people, and just like Parking Eye, can only threaten you. Might even be another name which Parking Eye go by.

Also, anyone know the legality of private companies clamping? A private car park near me threatens to clamp those not paying/staying too long. This only applies 9-5pm so I make sure to park outside of those hours, but just wondering if they actually would clamp your car?

Or, more likely, they get it from 192.com ... they've probably got a subscription as they no doubt use it on a daily basis!

Think of the phone calls as free entertainment.

Note the only people who can legally seize goods etc is a court appointed bailiff. As they have not taken you to court yet, they can't do that. The debt collector is just to try scare you into paying, and they have no more legal right to demand money than you do to demand I pay you £120. Tell em to hop it.

Just remember the golden rules, never confirm you were the driver - leave them guessing at all times. If you can just ignore and avoid all contact is the best approach.

Does it make a difference that I have used there car park in the past as well for grocery shopping, Hve not parked there since scared in case they will tag me/car again...
