Parking Query - What are my rights?

OK... a question for any legal eagles out there...

I own a property that is divided into 2 flats, the garden has been converted into a driveway with a drop-down kerb for use by the tenants. However, as parking is at a premium in the area I have found that some of the locals have from time to time used my driveway to park their cars.

I've tried a clamping firm however their notices get ripped down, and they don't seem particularly interested in enforcing such a small space.

What are my rights... what can I do... can I clamp them my self? It's NOT a public area, it's my driveway!

    Any advice welcome!

    Thanks

    Fox

what about putting some gates up or one of those lockable posts that goes in the middle of the drive?

I've thought about the post things, would need 3 of them and to be honest it takes the p*ss that I should have to go to lengths like that!

The private parking around my university has those (well some do). Looks like the best way to go imho... Will cause everyone the least amount of grief and expense!

You could just steal their tyres... :P

I'd personally park over the drive if someone parks there and block them in. You are not obstructing them as it's your property.

It does, but I am 100% sure to operate as a clamper you need a SIA … It does, but I am 100% sure to operate as a clamper you need a SIA licence, just checked, so in the long run, you may want to look at something else.

I know that you have to be licenced to clamp, but this is a private driveway, like the one outside the front of lots of peoples houses, in fact it was a garden...

So does it mean that I can park my car wherever I want (driveways, gardens etc...) and so long as the owner of that property isn't a licenced clamper or employs a clamping company, I'm good to go?

call the police, trespassing, get them towed, uplifted.

A nice thought, the Police round here aren't interested in anything other than stabbings and speeding, I won't hold my breath for that one...

Much as I hate to admit it, I think bollards are the way forward... I wonder if I can consider their car as being abandoned and strip it of anything valuable then drag it out onto the road on to double yellows, hmmm.....

I was thinking about making up some A4 stickers saying something like "Private Property - No Parking" and sticking them on the windscreen, would have to be stickers that are a real bit*ch to get off tho, any ideas?

i have had this problem at my old place. it was a one car driveway in a narrow street, and i found people parkign in my drive. becasue it was a long road with no where else to park, i called the police station and they contacted the owners of the cars and they moved them, The owners had the cheek to have a go at me for calling the police, even tho they were parked in my provate driveway!!!

once i got home and a visitor to my neighbor had blocked my drive i couldnt get on, it happened a few more times so i parked right behind him totally blocking him in and went for a looooooong walk with the dog ..........it never happened again....... sometimes to make people see the inconvenience they are causing you have to cause them some

Maybe a post either side and a length of chain with strong padlocks. Might be a cheap and easy option until you decide on any other necessary measures

I definatly like Wooly's idea - seems the cheapest and probably the most effective

keep puttin there tyres down they will get annoyed and stop parkin there or stick a knife in it just dont get caught

Try bollards,,,some look ok others a bit industrial,,,

To start with I would wait until one of the locals parks there and then position something in front of the drive so that they cannot get out. It would be nice if you could leave it there for a week or more. Then they might get the message.

I know that this is not what you want but look at www.parkatmyhouse.com
There may be a way that you CAN charge somebody if they park on your drive.
This could act as a deterrent

lol hire a skip and just leave it behind one of their cars

wow didnt know people would even think about parking in someones drive. put a pile of bricks infront of there car so they cant get out.

i would block them in for as long as possible that should get the message accross, or some gates you can lock ?

Perhaps you could put the said bollards up but don't put them in the "up" position straight away, have a little fun and only put them up and lock them after the stranger has parked on the drive, then watch them squirm when they can't get the car off the drive again, might as well get a bit of fun from them before you use them properly.

Alternatively, what about putting a leaflet/sticker under their windscreen saying that it is a private driveway and if they park there again then you will take legal action against them as you will hand their number plate to the police, hopefully this might prevent them from parking there again.

As said above, I can't believe that people just park on someone else's driveway, I wouldn't dare to in case my car was trashed when I got back - bizarre!!

i wouldnt do anything to damage the cars because quite apart from it being illegal, they obviously know where you live and would be very angry and might harm your home, or you somehow.

do the people who park in your driveway know the neighbours somehow? if its people who know people YOU know, just have a chat with them about it and see if they can check with you first before they park there so you can say no, when they ask!

If its just any Tom, Dick or Harry, I think you are going to have to find a way of blocking your driveway somehow, if its so big you would need three bollards just so a car cant get inbetween think of having some gates fitted?

I feel bad for you, no-one has a right to invade your space like that x x

lol, exactly as i was going to say. Leave it there for as long as is possible, if they say anything just say its gonna be there for a week/month/6 months because you are doing some work in the house and it cant be moved. Then remind them its private property, they should have known the risks, and tell them were to get off.
