    paypal dispute

    hi all,

    I bought a cosmetic item from depop, which turned out to be fake. The seller agreed to refund me but for me to wait until the 25th July as she doesn't get paid until then. Then I saw she had bought something else after agreeing to refund me!

    I have opened a dispute about this as I think it's taking the **** big time, but if she genuinely has no money, will paypal take it from her paypal balance? Will i be left out of pocket? I paid by goods and services, so I had the option to make a claim if something like this ever happened.

    they will probably ask you to prove its fake.If they side with you if she has money in her paypal account that will be used to reimburse you otherwise paypal will use there own money to refund you and her account will be in a negative.

    yes, in depop it shows 'activity', and at 10 this morning she spent £15 on a playsuit instead of refunding me!

    Regardless of where it was bought the seller is taking the preverbial so just carry on with your dispute, why should you wait until the end of the month? Paypal will just refund you regardless of whether the seller has money in their paypal account, they will just chase for the payment from them.

    it was on Depop. a buying/selling app a bit like instagram. It's usually really good.

    I don't know whether to give the seller a chance to reply or escalate? maybe wait until she puts it in the claim that she agreed to refund me, so I have a better chance?
    I blocked her on Depop so the only correspondance we would have from now on is in the claim.
    I was annoyed when she first asked me to wait another 2 weeks, but absolutely seething after I see she's bought something!! what is wrong with people.

    I would be seething to, I would not be giving her any chances to be honest and would just escalate it as soon as I could.

    It's quite a new thing i think. the way it works is you just upload a photo and a description, a few hashtags to help people find your product, choose a price. Much like ebay but i think it's much simpler. depop take 10% of the final price, and paypal take their cut. You can always just pm people your paypal address to cut out the depop fees though which is good.

    I want her to say 'yes i did agree but i'm poor until the 25th' so paypal see that she has agreed but that it's not fair on me to wait so long, before i click escalate! She seemed genuine when I said it wasn't a real product that the company make, but it really isn't my problem so i don't want to wait 2 weeks. I went on live chat to the company in question and they agreed that they had never made packaging like what she had sent to me, so I've got a little help there.

    Raise a claim straight away. No reputable seller will tell you to wait for a refund. No time to waste.

    Don't worry about her account, she screwed you.

    And no, if she has no money it'll just put her PayPal account into -£ whatever the amount.

    Then it's PayPals problem with them, (talking from experience with eBay fees, when my account was empty til payday)

    Just go through with it and make sure you get your refund, not your fault she has no money in her account. After all, it's her that sold you the fake, so take your own money back.

    I think the put her balance into negative by the amount she owes you. You wont lose out xxx

    Sellers usually have to sign up to authorise the company (ebay I know for sure) a credit card on file for backup, incase of being no paypal funds - so they can debit their card if no money in paypal .

    Hi all- update-

    PayPal decided in my favour after 2 days of the escalation. They wanted me to send the item back for a refund! I phoned them and said I wouldn't as it was a fake product which couldn't be sold on regardless, the advisor agreed with me and refunded me straight away. The product has been thrown in the bin of course, I wouldn't want her taking a chance on someone not familiar with the brand!

    Thanks! Couldn't believe she wanted it back probably to sell on to someone with no clue!
