Precedure when seller refuses to refund??

Found 1st Feb 2010
I have paid for faulty straighteners on the 31st of December.
Item was not sent until 15days later (had to chase on a couple of occasions)
18th of January arrived as faulty requested a refund.
Same day seller says that they have no money whatsoever to refund money - agreed in bona fide, to wait for seller payday 29 jan
26 jan no email no refund
26 jan seller bought for £18 kids clothing (and done many other deals in between me waiting for my refund)
31 jan seller bothers to reply that they have no money - may have to borrow - but I am still waiting!

I haven't refused to refund, I have explained the situation to you and am trying to find some money. As my husband has said, they were fine when they left me, I have no proof that you didn't break them yourself. I cannot get my money back from post office without the straightners so I am out of pocket too. I did explain everything via pm. I did buy clothes and nappies for my children as they needed them. The only reason I have less money than I thought is due to the reason I explained to you in a pm.

Perhaps give the OP a part refund until you can afford the rest.

At the end of the day it's your responsibility to refund the buyer even if you get zilch from RM.

You have proof that they were not damaged by myself as the picture you posted show (with hindsight) that the plate was not attached to the main body of the straighteners. As you can understand I am disappointed that you say you have no money when you openly bought here for kids clothing and shirts. For amonts OVER what you owe to me. I dont know about you but I like to pay my debts before I go and spend other people money.

I am glad I did not return them as otherwise I' d be left with nothing!

Yes but I have to refund first. I have a valid reason for having no money which I have explained to op. I am trying to find money, I am selling my childrens double buggy elsewhere, if someone buys it I can pay back.

The bundle I bought had been held for a month for me as my children needed clothes and nappies. I did have money left to refund you but for reasons that I have explained, I had to hand it over to other people. I am trying to borrow money. You say in the pic it looked loose, so why did you buy them if you thought they looked broken? I was still using them just fine before they were posted.

I agree it is not but that was bought for my step dad and he paid for that, he just can't get on with this site

it is between you and the seller, normal practise here is for seller to refund and claim back from royal mail and remember to leave appropriate feedback

To be honest if I sell something I wouldn't spend the money received until the buyer lets me know everything is ok, here to add insult to injury they spent my money on other stuff instead of refunding me 15 days later....

i appreciate this, from the picture they clearly looked faulty, so not sure why you where still using them like this and also not sure why the buyer purchased, if its to good to be true it usually is, faulty ghds go for more than this on ebay so dont belive you had the intention of ripping anyone off, as for the buyer well i can see why they jumped in with both feet

Sorry but it doesnt work like that on ebay and it doesnt work like that on here.

Once goods are back with the seller, then you can have a moan if the refund isnt forthcoming :thumbsup:

when I received the parcel and unwrapped the straighteners the plate was completely off, can be pushed back in place but is not secure and comes dislodged easily. So i looked back a the thread to see if they were like that before they were sent and low and behold the pic indeed does show that the plate is not aligned properly. I didnt give it a second thought when I saw the pic that it was a fault. If I had bought them with another motif I would be selling them on Ebay myself and keep my mouth shut but I only bought for personal use and not to make a personal gain.

I had no intention of ripping anyone off, I was open about how long I had them, I had a new set so just wanted to get rid of them. If op wasnt happy with them when she saw pic then why buy them

a mod has now answered your response in the actual thread in the fs boards, mummy i would ask them to be returned to check out they are infact the ones you sold, refund and sell on ebay, you will get your money back through ebay

I know some people even after having them longer than the 2 year guarantee have returned then to GHD and had them repaired/replaced,maybe worth a try:thumbsup:

mummylace & Bikebarbie we asks buyers & sellers to communicate with each other & resolve these matters as amicably as possible.

mummylace. if these items weren't damaged when you sent them, then they could have been damaged in transit & its up to you as the seller to claim for this & refund your buyer.

Bikebarbie, if the OP does require the goods to make a claim from Royal Mail then you should arrange to return them otherwise you are the one preventing the process from progressing.

No one is accusing any one of being at fault, but you should both work together to resolve this & be communicating directly rather than via the MISC forum.

You are both aware of the situation & what now needs to be done - please agree off thread the next step to a suitable resolution to this. Things can go wrong with items in transit that can be out of your control - part of the feedback rating should reflect not what goes wrong, but what the parties do to resolve the situation.

mummylace, you are not helping the situation with comments like this - thread closed. Read my previous thread post. The buyer is giving you the benefit of the doubt & saying that they could have been damaged in transit, you are saying the buyer may have switched them ? Make arrangements for the refund & do not engage in any further trades until the matter is resolved. And try to keep it amicable & based on actual facts please.

Just to clarify the ongoing dispute between whether items should be refunded first or returned then refunded. I've double checked this with Admin Team and :

> BUYER RETURNS ITEMS TO SELLER

> BUYER CLAIMS COMPENSATION FOR DAMAGED GOODS

This is the normal process in matters like this & the normal procedure. So a refund should be issued before the process can continue. So mummylace, the next action lies with you at this stage.
