Problem with car MOT, where do I stand?

On Monday I had my car MOT'ed at Mr Tyre Tamworth.
Although they state on their website they provide MOT's, they don't do the MOT's but take it to a third party and take a cut of the payment.
Got a call to say it had failed on brakes & bearings, cost to put right £350 total (inc MOT & VAT). It was more than I thought but agreed to pay.
Tuesday morning it was taken for the re-test, failed on brakes again (allignment) and was told the caliper would have to be changed + additional test to be paid for, total cost was now £625.
The car is worth around £700, I asked the guy who rang me what he thought I would say if after the first test he had told me £625 to put it through the MOT, he said I would not have had it done, which was correct.
I was now trapped, if I said no I would still owe them £350 and my car would still have no MOT, I had no choice but to say yes.
It was re-MOT'ed yesterday and I was told to pick it up at 5.15pm. When I went to get it I was told it was on its way back from being MOT'ed. It failed again.
This time it was a bolt (still brakes), could just be replacing it, if not the hub would need replacing, hundreds of pounds if so.
Awaiting call, what are my rights.

If they were doing their job right ALL those things would have shown up on the first pass through the MOT. Their taking the mick royally. A call to trading standards would be a good move at this point...

i agree, with steve, sounds dodgy to me, the whole point of the MOT is find whats wrong, i would refuse to pay it and buy another cheap car with the money you would of spent on it lol

I would consult trading standards... seriously. 3 Fails!? and this garage have supposedly sorted the issue but keep finding more probs!? Whats worse is they keep finding new problems each fail...why are they not finding them all in one go

Take it to another garage for a Pre-MOT test which will show up any faults and ask if it should cost over £600 for the brakes to be done. Then ring the original garage with the findings.

Alternatively tell em to keep the car and buy a new one with the money they want just to fix the brakes!!!

No, the point of the MOT is to find if anything is wrong, not to diagnose the fault. That's down to Mr Tyre, they ****** up the diagnosis and the work by the sounds of it. Deffo a TS jobbie.

If the first report didn't pick up the second set of faults then it looks like the MOT people are at fault. If the faults were reported but weren't actioned by the garage then it's the garage at fault.

Ask to see the original MOT report, the paperwork to show that the required rectification work had been done, & the second MOT report showing either that the work hadn't been done or that the car failed because of an incorrect original report - that will get them sweating...

Dont think VOSA would be intrested, Mr Tyre are not doing the work up to standard by the looks of it hence the MOT place are failing it

trading standards are great on this as they really sorted out the jerks that ripped my sister off similar story to yours dont fret about it ring trading standards

VOSA are responsible for inforcement of all regulations concerning vehicles and operator services
therefore they are basically the trading standards of car services and should be contacted when an MOT comes into the equation even if the garages involvement has been minimal.

the garage in question is not VOSA registered! it's not an MoT station.

They are pulling a fast one, sounds like they ****ed up the callipers when replacing the brakes.

Guy near me charged me £20 to replace the brake pads btw, I done both my rear bearings on my car cost £40 for original parts and an hour to replace (my first time).

Just give them the car as payment if you can't be bothered with the hassle, otherwise trading standards :thumbsup:

on slightly differnet note:-

My clio was recently up for MOT, so on my way to the test centre I was bit early & noticed a garage on the way would do a free 10min check ..light alignment, breaks ect ect
So I thought I would see what they said PRIOR to the MOT test.

They told me it would fail on headlight alignmet which they could remedy for £20 & if I didn;t it would fail the MOT & I would have to pay a re-test fee & also somebody (eg them) to align my headlights... I said I would take my chances... lo & behold my clio passed - no problem with the headlight alignment

My lesson learned:-
Let the MOT test centre tell you whats wrong then get a garage to fix that problem.
When you take it back to the MOT centre for re-test they only test you on what failed the first time ;-)

Well said, I have a rubbish old BMW which I cart my dogs to and from the woods in.

I took it for it's MOT and it failed, they said it needed 750 worth of work to get it through.

Took it to the garage which service my merc, they looked at the quote, said IF it needs all this done it would only cost 375.

30 minutes later it had passed with nothing being done.

What happens if the vehicle fails the test?
You will get an inspection record sheet/notification of refusal listing the faults, and a retest application form. We charge reduced fees for retests, if we receive the application for re-test within 21 days of the original full test

After failure, fees for re-examination vary according to the following circumstances:

If your vehicle is left with the Testing Station for repair and re-examination – NO FEE

If the vehicle is taken away from the Testing Station and returns for re-examination on other than one or more of the items listed below, then only the failed item (including any other items affected by the execution of the repair) needs to be examined by the MOT Tester, for which the Testing Station may charge (up to), half the full Test fee. my clio has even passed on one occasion with the following faults...

1x front side-light faulty
1x break light faulty
1x number plate bulb faulty

and exhaust fell of on the way home - I blamed the MOT test centre for that!

I was referring to free re-tests. Only free if returned within 24 hours and only free for a re-test of certain items (not brakes etc). Otherwise half the fee is payable up to 14 days after initial test :thumbsup:

I use tesco clubcard tokens (£15) for nationwide test and get any work done off site and then pay £26 for a re-test

my hubbys car was late for its mot and when i took it they gave it the once over told me what was wrong how much it wpould be and did i want to go ahead they should know exaclty what needs doing and have it done if it does not pass then its up to them to correct it and not charge you again for it and apart from that thats a total rip off! i hope you get it sorted

meaning?
when our cars are due for mot i always ask the garage who also does their service reguarly to to give them a check as me or my hubby are not mechanically minded and wouldnt know if there was any potential faults so rather than fail an mot i would rather the garage lokk it over 1st to save time and money you got a problem with that?
