My ps3 has got the yellow light. I have had the ps3 for around 2 years. I rang sony up to tell them the problem and thy said it will cost me £131 to get a refurbished one. So i tried to argue my case by mentioning the consumers right act 1988 in which all electrical goods have 3 years warranty. But the guy was adamant and said no he cant do anything. Can anyone please tell me what i could do because i'm not paying £131?

I told them that i've got a sony tv and i was put through to the manager but still no help.

He knew it doesn't exist, so decided that you were trying to work him from behind.

Do you mean the consumer protection act of 1987?

have you registered the PS3 with Sony? might help, no idea why.

That's the only way your going to get them to replace it for free, you just have to keep ringing...

was the 3 year thing a lie, or is it actually true?

If you're a kid, get your parents to sort it out for you - unless you sound older, people on the phone (or in person) won't take you seriously.

You definitely won't get anywhere citing the Sale of Goods Act to one of the reps on the phone - you need to speak to their manager. I appreciate you've already tried this, but you'll just have to keep trying! You could also try going into the store where the PS3 was purchased (if it was a gift, you'll just have to ask the person where it came from and if they still have the reciept) and citing the Sale of Goods Act to the store manager. Probably won't get you anywhere to be honest - I see plenty of threads on here where people try their luck, but not as many success stories.

Might just be easier to sell it as faulty (having the warranty seal intact will increase its value, so don't bust it open and try a DIY fix) and buy a new/2nd hand one.

Is it a 60gb version?

Keep calling back and you may get lucky. A year or so ago it happen to a guy at work and he got nowhere; couple of weeks later, it happened to me (My PS3 was 2 years old) and the first person I spoke to arranged it to be collected by courier within 24 hours and exhanged on the spot for a like for like model. No charge at all.

The sales of goods act is used mainly by the consumer against the place your bought the item not the manufacturer, so whoever that bought it for you get them to, if they have a receipt, to speak to the store.

You need to ask to speak to someone senior and state the sales of goods act s.14 which states that the goods supplied are of satisfactory quality. (it's too long for me to type and will probably bore you)
Use the template below to write to them, as this often more effective than phoning and speaking to people who may not have the right authority to authorise exchanges.

*Dear Sir/Madam,

RE: Faulty goods and the Sale of Goods Act 1979 (as amended)

On [date of purchase] I bought a [description of purchase] from you for [insert price] which has stopped working.

The problem is [enter description of fault].

The Sale of Goods Act 1979 (as amended) states that when a consumer buys goods from a trader they must be: as described; of a satisfactory quality; and fit for any purpose made known at the time of sale to the seller.

This legislation also states that the seller, not the manufacturer, is legally obliged to sort out a problem if the goods do not meet these requirements.

The law also says I have six years from the date of purchase to claim damages for faulty goods.

My goods are not [delete as appropriate - as described/fit for purpose/of satisfactory quality] and I wish to claim a [delete as appropriate - repair/replacement/refund] of my goods under the Sale of Goods Act 1979 as amended.

Please respond to my complaint within 7 days from receipt of this letter.

Yours faithfully,
[your name]

If you want to sell your 60gb then I then you can get a lot of money for them, even if faulty as they're quite rare now.... Just an option, but I know for sure you can get a replaced for free if you keep ringing, state your loyalty, and speak to the manager etc.
