I purchased a pair of Dr Martens on ebay, let's be honest i paid £35 when the price on the Dr Martens site was £119, they sent the wrong size and they smell
You ordered from China at a "knock down " price and expected a genuine article ? . Do folks still have that expectation after all the publicity on here and other sites ?
Yes follow the advice above , but if the listing said "Doc Marten style "or "Doc Marten pattern " etc ie not "Genuine Doc Martens " your claim will likely fail. Very luckily for you though you should get your refund as they sent the wrong size . Lesson learnt ? (edited)
Hmm surely you weren’t expecting them to be genuine when bought from China at fraction of the usual cost.
I know we get used to seeing huge discount on HUKD’s but alarms bells should have been ringing when you were buying on eBay and from China. EBay is well known to be full of fakes.
You have the option to now open a significantly not as described case as they are both the wrong size and fake. Should be cut a dry straight forward case were eBay will rule in your favour due to the size been incorrect. (edited)
Open a ebay return - ebay will provide a free tracked returns label - send them back and you should get a full refund once the tracking shows returned - just keep a receipt from the post office to cover yourself bud
As I said earlier ," Dr Doc Martens", So not a fake - a similar but not …As I said earlier ," Dr Doc Martens", So not a fake - a similar but not identical name . Genuine ones are called Dr Martens . Do you see the difference now ?
Wrong. If you look at photos it's clearly labelled Dr Martens hence fake still. Sellers put lots of crap into title to get searched Obvious would be fake but claim is still there
Tell the seller your sending them back with your reasons do this via the messaging on eBay do not give negative feedback at this time the seller has 21 days to respond if you get nowhere after this time contact eBay and tell them they will then act on your behalf do not delete any messages keep all invoices .

Only argument you have is wrong size and possibly smell unless it said genuine. " let's be honest i paid £35" "China" The rest you have to be honest with yourself.

Cut off your losses ... or your toes. If you cut off your toes, will they fit?

At a guess OP bought DR Doc Martens , not Dr Martens - so they weren't fakes - just cunningly labelled to suck in those who have faith in Chinese knock offs ?
As I said earlier ," Dr Doc Martens", So not a fake - a similar but not identical name . Genuine ones are called Dr Martens . Do you see the difference now ? (edited)
Message them saying you believe they're fake.you want a full refund including return postage. Failing that open a PayPal dispute.
Anonymous User
They’ll still smell though..,
Ebay states that if products are fake then you don't have to return them for a refund, just open a dispute through ebay
The type of buyers that these type of sellers dread.

What rogparki said, you bought Dr Doc Martens as the title says, they are obviously a copy of Dr. Martens and don’t claim to be genuine. The sellers are clever with the title & description
The sizing is given in EUR plus UK Women’s & Men’s sizes
You might actually struggle with this case. As they may have sent you what you ordered.
Do you have a link to the listing you bought from?
Well, at least you're being honest with yourself. No one likes to be sold a 'pup' but your spider-sense should've been on serious 'tingle' mode with this.
All you can do I guess is contact them with your thoughts. Trouble is, they tend to bank on those who will give up without a fight as they know it'll cost you more in hassle to return. Probably offer you a partial refund to keep them but stick to your guns as they are clearly in the wrong - especially as (genuine-ness aside) they sent you the wrong size.
Good luck OP. I hope it works out for you. Just remember next time - if it looks like a duck and quacks like a duck...
Regards, Phsy.
people do know that doc some martens are made in china now?
Bear in mind that shoe sizes differ across the world, They may be marked as the wrong size but they could correspond to the UK size you ordered. If they're obvious fakes I would concentrate on that aspect.
As mentioned it also takes the shoes out of circulation rather than sending them back to be re-sold to someone else.

I think it would be helpful for the op to post the listing as the sizing issue maybe as you suggested. Sometimes these China sellers are sneaky with the title and description and may not mention been genuine so they might not have a case for them fake as it’s really depends what the listing said.

Loads of items are made in China but still a huge number of fakes are sold been Chinese sellers.
Its highly unlikely when buying for a fraction of the items value coming from China that it will be genuine. It’s the same with sites like wish full of fakes.
I thought this was common knowledge but perhaps not.
The email i received in reply. ---------------------------------------------------------------------- Dear Buyer Thank you for your letter, we're sorry to make you unhappy. Our shoes are of good quality, many people buy them, and the feedback is good. You can see the price of our shoes, if compared with GBP100 more shoes, we may not be so perfect, please understand. It's normal for shoes to smell a little bit, you can open the shoe box and place it for a while. None of our regular customers send shoe boxes. Warehouse sometimes shoe box will be wrong, but the size of the shoes inside is suitable for you, please try to wear shoes first, to confirm whether the fit. If you have any questions, please contact us. Thank you

This isn't always the case. I unknowingly purchased a fake item and although it was a very good copy and not that easy to spot, I opened a case with eBay and needed to wait for the seller to respond, and still needed to send back the item. The postage label provided also didn't have any tracking, so the seller could say they never received it back. Too be fair the seller would have most probably not know the item was fake.

What did I tell you eh? I figured that's how it would go. I think you played a fair hand as they would have definitely been 'out of pocket' on this one. Mind you, with the sheer volume of sales that they do - probably not.
I guess if the boots are of no use to you then maybe leave them to air so the 'smell' dies down and bung them on Gumtree to recover your loss (and maybe even make a bob or two) but don't try advertising them as "geniune" DM's or you might face the same issue as you've just had but the other way round. You know, boot on the other foot so-to-speak! Groan! - I know...hehe.
Thanks for letting us know the outcome OP. It's always good to know how a 'problem' panned out - if only for other people who face a similar issue.
