Thank you, just the response I needed.

My neighbours washed their car earlier outside our house, something we don't have a problem with despite the fact we do not get on with them at all).

Anyway, the water left over froze very quickly and it is unnoticeable, just a sheen on the floor. A couple of people have slipped over so far and have confronted the guy about it and his response is simply "f off"

What an idiotic question

Supermod

Are you saying you arent normal?

True if its rains but if it can be proved that the individual caused the ice to form due to washing the car and someone fell then you would be liable

What twaddle.

If I wash my car on my drive and waters flows off the property onto a footpath it isn't my fault if it freezes. That is due to weather and it being cold.

You would have to prove I was negligent or placed the water there with the intention of making you slip on it. As I was simply washing my car then any claim is going to be very difficult to prove in court.

You're more likely to be able to make a valid claim if I attempt to salt the area or clear it and dont do it properly;-)

which is exactly why the council no longer clear footpaths in winter, so they are not liable for people who will inevitably still slip on it

Film passers by and send it to you've been framed.

Nope sorry you are wrong you have a duty of care being a householder for any individual who may be on or near your property. The words DUTY OF CARE is the phrase that is important as you are aware that the water may freeze and as such you fail in your duty of care if someone is injured as a consequence. Proof is not the case in this matter it is up to the judge to make a judgement as to if the breach was intentional. For weather related problems ie if it rains then freezes that is not a something you can be blamed for as you did not make it rain but if you clear the ice or snow and not do a competent job and a injury is caused then you can be again liable.
