Retrieving Money From a Company?

Hi

I trying to get back money back from a dodgy company by the name of Direct LGV.

I used moneyclaim.gov.uk. So far it cost me £60.00 for MCOL to send this company a letter. Anyway the company did not respond to letter. So the next step with MCOL is to pay a further £100.00 and they send a warrant.

So i rang and spoke to a MCOL employee and asked will i get my money due to paying them more money. NO! was the answer. Turns out if this company still don't want to pay me they get bad credit rating.

Would a solicitor and county court small claims be the only way?

Did you pay on a credit card, or visa debit card? If so you should do a chargeback with them which won't cost you anything.

If you paid by credit card you're likely to be insured.

But yes beyond that you're correct in assuming the county court small claims track is the way to go.

Did they complete and send a Letter Before Action for you for £60 or did they issue a Claim for you against this company?

I think you may be allowed to instruct bailiffs, but at your own cost, i may be wrong

Only when you have entered Judgment and then applied to the Courts for a Warrant of Execution (or Writ of Fieri Facias).

Why do you consider the Company involved to be "dodgy"?

Have they taken payment for something & not delivered?

Apart from the small claims court, shouldn't a visit to your local Police station be a consideration?

Also, maybe a conversation with somebody from the Citizen's Advice Bureau would save you spending more money in trying to recoup your losses.
