returning to work after maternity leave.

im due back to work in june and just spoke to my manager who ive never met before as the other one left while ive been away, i told her what shifts and hours i would like when i return, i still want the same shift but i only want 16 hours instead of 30. anyway she was going on saying how things have changed since ive not been there and basically if i want to go back then i have to do evenings aswel as mornings, i cant possibly do evenings as my partner works from 2pm-10pm thats why i have always done mornings. im still in contact with a girl from my work and ive just asked her if one of the girls i know still only does mornings as she has a child and she does, so my question is that surely if one staff member is allowed to do just mornings then why cant i. isnt it discrimination in some form. its not like i use to do evenings and now i want earlies ive always worked in the morning.

i am going into work on tuesday to see her so just want to get all the right info before i say things incase there not true, i am going to ring acas first thing monday and see what they say.

You are legally entitled to go back to the job, hours and time am sure that you did before going on mat leave.
To ask a mother of a young child to work nights when she didn't before is ludicrous, you have the right to apply to reduce your hours, but this might be rejected if it is not in the business's interest, however they have to give a valid case as to what reasons not to. (i think thats right!)

Best to speak to your manager about it. They can change the hours only if it is a business necessity and although 1 person is on only mornings it might not be feasible for a second employee to be on mornings only.

And I wouldn't go banding around discrimination to the manager as you also want to change your work conditions out of necessity so it’s only fair that the business can do so too

Yer you are entitled for them to look after you. Make sure they dont walk all over you.

why i mentioned discrimination is i only did mornings before i went on maternity leave and so did this other girl, now the manager says there have been some changes since i left but this other girl is still only doing mornings so if they havent changed her hours why are they changing mine. she only does mornings to fit in with childcare the same reason i only did mornings it just doent seem fair to me.

It's hardly discriminating againist people on maternity leave then as the other girl is on mornings. As I said it may not be feasible to have 2 people doing mornings only. Your manager said there have been changes, these may be out of their control due to recession etc so the might not be able to accomodate you as mornings only.

Take it up with your Trade Union Rep.

its a care home, there is no union and the changes thay have made is just set rotas so the shifts just repeat themselfs every 4 weeks nothing major, thats why i dont understand why they changed my shifts and not the other girls.it just seems strange to me and unfair they can accomadate other mothers but not me.

im going in to see her tuesday so will see what happens, my partner keeps telling me not to go back as its not worth it for 16 hours at minimum wage and a 20min drive there and back. i think i will go insane if i dont work a few hours a week, if only just to get out for a bit and not watch cbeebies lol if they cant sort my hours out i will just leave and get a job closer to home i suppose.
