Phone Pouch Giveaway
1. The Organisers
(1) ROYAL NATIONAL LIFEBOAT INSTITUTION a charity registered in England and Wales (209603), Scotland (SC037736) and the Republic of Ireland (CHY 2678 20003326), the Bailiwick of Jersey (14), the Isle of Man (1308 and 006329F), the Bailiwick of Guernsey and Alderney of West Quay Road, Poole, Dorset BH15 1HZ (“the RNLI”).
(2) MARITIME AND COASTGUARD AGENCY of Spring Place of 105 Commercial Road, Southampton SO15 1EG (“MCA”).
The RNLI and MCA are collectively referred to as (“the Organisers”).
2. The Phone Pouch Giveaway
2.1 The RNLI and MCA have teamed up to run a Phone Pouch Giveaway aimed at assisting recreational and commercial water users to contact rescue and support agencies if they get into difficulty while on the water. (“Phone Pouch Giveaway”).
2.2 The RNLI and MCA will provide, free of charge, 8,000 Mobile Phone Pouches during the Phone Pouch Giveaway.
3. How to apply for a Mobile Phone Pouch
3.1 The Phone Pouch Giveaway will run from 11:00 am on 12 April 2022 (the "Opening Date") to 11:00 am on 26 April 2022 (the "Closing Date") inclusive.
3.2 All applications must be made to the MCA via smartsurvey.co.uk/s/P…22/ and must be received by the MCA by no later than 11:00 am on the Closing Date. All applications received after the Closing Date are automatically disqualified.
3.3 To apply for a Mobile Phone Pouch visit smartsurvey.co.uk/s/P…2/, complete the questions and enter your contact details.
3.4 No purchase or donation is necessary, and there is no charge for use of the website.
3.5 The Organisers will not accept responsibility for applications that are lost, mislaid, damaged, or delayed in submission, regardless of cause, including, for example, because of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.6 By applying, you are agreeing to be bound by these terms and conditions.
4. Eligibility
4.1 The competition is only open to all residents in the UK aged 18 years or over.
4.2 In applying for a Mobile Phone Pouch, you confirm that you are eligible to do so and eligible to receive the Mobile Phone Pouch. The Organisers may require you to provide proof that you are eligible to apply for a Mobile Phone Pouch.
4.3 There is a limit of one application per household.
5. The Mobile Phone Pouch
5.1 The mobile phone pouch is a transparent, recycled plastic phone pouch with a safety message on the front and Organiser’s branding ( “Mobile Phone Pouch”). Eight Thousand (8,000) Mobile Phone Pouches are available to be supplied.
5.2 Mobile Phone Pouches are subject to availability. There is no guarantee you will receive one. There is no cash alternative for a Mobile Phone Pouch.
5.3 The Organisers reserve the right to replace the advertised Mobile Phone Pouches with an alternative mobile phone pouch of equal or higher value if circumstances beyond the Organiser’s control makes it desirable to do so.
5.4 To the extent permitted by law, no warranty is given for the Mobile Phone Pouch. IN PARTICULAR THE ORGANISERS DO NOT GUARANTEE THAT THE MOBILE PHONE POUCH IS 100% WATERPROOF. PLEASE BE THOUGHTFUL BEFORE PUTTING EXPENSIVE ITEMS INTO THE MOBILE POUCH.
5.5 The Mobile Phone Pouch is not transferable to a third party and cannot be sold by the recipient. It is for your personal use only when in a water environment.
6. Award of Mobile Phone Pouches
6.1 Mobile Phone Pouches will be awarded to applicants on a random selection basis. The Organisers do not guarantee that all applicants will receive a Mobile Phone Pouch. The decision of RNLI and MCA is final. No correspondence or discussion will be entered into.
7. Delivery of Mobile Phone Pouch
7.1 The MCA or their agent will deliver the Mobile Phone Pouch to the randomly selected applicants at the address in the application as soon as practicable after the Closing Date.
7.2 The Organisers do not accept any responsibility if you are not able to accept delivery.
8. Limitation of liability
Insofar as is permitted by law, the RNLI and / or the MCA, their employees or agents shall be neither jointly nor severally liable, nor in any circumstances be responsible or liable to compensate the applicant or accept any liability for any loss, damage, personal injury or death occurring as a result of receiving a Mobile Phone Pouch, except where it is caused by the negligence of the Organisers, their agents or their employees. The Organisers do not exclude liability for fraud, or death or personal injury caused by their negligence. Your statutory rights are not affected.
9. Data protection and publicity
9.1 The MCA will only process your personal information as set out in the MCA privacy policy. The RNLI will not receive any of your personal information.
9.2 The Organisers may publicise the Phone Pouch Giveaway in any manner they see fit including on any RNLI and or MCA social media channels.
10. General
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Organisers may, at their sole discretion, reserve the right to exclude you from participating in the Phone Pouch Giveaway.
10.2 The Organisers reserves the right to terminate, suspend, cancel, or amend the Phone Pouch Giveaway where in their sole opinion it becomes necessary to do so.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales
