Securing a hotel booking by card

If you made a booking, say through laterooms for 1 night hotel stay for someone, secured it by card,no payment is taken, the card is just in case they dont turn up or whatever, but the person arrives, pays in cash, stays the night and all fine,

next day however they decide to stay for an extra night and arrange this directly with the hotel,

after they leave, the hotel has no record of them paying for the 2nd night so charges the card which the original booking was made,

would this be legal? anyone know? bearing in mind it wasn't the card holder staying and they gave no authorisation for the 2nd night to be charged to their card

I would imagine it's legal - the card has been provided as 'guarantor' so I would advise the card holder to seek advice from their card provider if they can't get it back from the actual person.

Probably legal as they probably *did* give authorisation for extra charges to be made to the card (as with most hotels, you swipe a credit card as a deposit/source for extra charges to be added to)...

"By proceeding to book accommodation and/or other services through the Site, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. If they are provided, we will endeavour (but undertake no liability to do so) to make copies of the accommodation provider's terms and conditions available to you."

Are you sure? It was probably also guarantor for extra charges. Say for example you trash the room or smoke in it - they are allowed to charge that to the card - so presumably the same applies to unpaid board fees...

Yes,if the room had got trashed or similar,or they lived it up,got room service, emptied the mini fridge, drank the bar dry etc that could have charged to the card...but only on the 1st night I would have thought,

day 2 is entirely different is it not, thats out of the contract time

Its also a guarantor, for any extras you may have such as room service and any damage you may cause.

Yes,I agree with that,on day 1 only though,

If you booked a hotel for a person for 1 night who's to say they wont decide to stay for a fortnight oO

As usual its a pretty standard policy to protect the hotels from scammers.

Quite a few years ago I did credit control at the Marriot hotel in Leeds, and business men were the worst for it, either covering up damage or complaining at additional charges, e.g Their company would usually only pay for bed and breakfast, and not for minibar or movies.
I remember one guy kicking off at 3 separate charges for movies, which showed as number codes on the bill, I had access to the Master list so knew exactly what films he was watching, and suggested I resolve the issue by ringing his boss and asking if their travel allowance covered pornography.
