Do you mean a small claims court case in the county court? if so then no, unless you are a lay representative or a mckenzian friend

The high court has a public gallery that you could sit in on, if it is open to the public as most civil cases are.

Oh i want to know what these things are like. I have sent off a final letter of demand today, if no payment received i will be going the small claims court. If they dont turn up do you still get your money back?

Yes. That'd be the best outcome for you I guess, automatic ruling in your favour. Just gotta hope they pay out with the order in place....

depends if they simply don't show you get automatic win, if they enter a written defence you still have to state your case to judge as i did.

Are you saying County Court for small claims is dfferent? (Which may well be the case)... But certainly anyone can view a case in a County court. Been there done that on two occasions.

The two lower tracks of small claims at the county court take place in a very small room (not a court room) around the table with the judge at the end and both parties on each side.

i wouldnt call it being asked... but I did attend!

First one was after a world cup game and a visit to the Chinese after 1 hour in the pub and being cheeky to the copper as he left the takeaway "no free meals tonight"... It proved to me that coppers lie through their teeth. Fortunately he thought he was being clever with his questions in court and didnt bank on a reply of "I cannot believe you are a policeman because all you've done today is lie through your teeth". The judge laughed too! Guv 1 Rozzers 0 I had probably drunk 2 pints at most that night. He just didnt like the fact he got turned down in the chinese! X)

The second time was on a boxing night at closing. 2 mates got stupid with each other. We all knew the police were around, but they kept starting on each other. Eventually someone jumped on the pair of them to stop them - just as the police turned up... and unfortunately they both ended on top of me and they didnt believe me or anyone else that I wasnt involved. An (extremely funny) night in the cells followed.... and had to appear in court the next day. If I had pleaded not guilty, (because it was a civil case) I would have not been released until 3 January! I took the £60 bound over for 6 months instead. So no record or anything like that....... Cant remember the charge maybe breach of the peace, but like I said, I genuinely did sweet FA on both occasions.

But going back to the funny night.....

The police eventually worked out which two had the problem with each other, so separated them and I ended up with one of them. The other was on his own. We kept hearing his shutter being opened and being spoken to. After about the 5th time, the copper shouts "if you ring that effing bell again, I'll do ya." I havent rung a bell he says.... I was just trying to turn the light off".... We cried ourselves to sleep with laughter.

Anyway... on both occasions there were witnesses and mates in the gallery.

UM GUV....the OP was asking about civil proceedings in front of a circuit judge, not a criminal case in the magistrates court.
