Kind Regards,

I have just spoken to a girl called Ciara from Play.com and she has assured me that nobody will be getting the box set at £9.99 - I said that some people have had confirmation emails, but she checked with a manager and they said they are not honouring any of them!!

So you had had the canellation email, but because you thought some people may get it and not you. You called and said some people didnt get cancellation emails whats going on.

Just to make sure no one got it...I like your spirit!

Sue them, get citizen advice involved, take it to the small claims court, Its the law i have a email, they have my money

Eh...... no it isn't!!

It really depends on which confirmation email people are on about. If its the 1st one confirming your order then you have little chance as they haven't taken your money.

Even if you have an online bank or credit card account that says the money has been taken that still doesn't mean they have taken it. Alot of companies ringfence funds i.e. they carry out the 1st part in requesting to take money from your card and your card company duly says yes you can here is an auth number. Unless, the company settle and send that auth back (can be up to 2 week later) saying yes we will take the money then NO contract has been formed. If they don't settle after about 2 weeks the ringfencing gets lifted by your bank as they assume the company is not going to settle against it.

Yes, its annoying as it means you pretty much have to wait until you get email number 2 saying they have debited your card. At that point a legal contract has been formed and yes go for broke on getting it.

hth

And yep I got email number 1 and then the no go away email too LOL

also just received cancelation email, no vouchers or anything :x

Ha, ha, ha. I love it. Fair point made. Someone was being sour and had to make sure if they didn't get it, no-one should.
Play.com are not gonna be loved after this!!

Ghostbusters ?

Even if they still take your money the contract is not legally binding until the goods are in your possesion. The law even gives them up to 28 days to return the payment before further action can be taken. Which is why i rarely deal with companies that take payment before the goods are dispatched, eg Empiredirect. I found this out to my horror when they did one of there famous misprices and it took 7 days to get my funds back and they were quite within their rights to do this.

Yep, got cancellation email too. Oh well we knew it was highly likely, some you win, some you loose.........
I would have loved to have been a fly on the wall at the Play.com order department this morning lol

Surely most people ordering it knew play would not honour the mistake. I knew that when I ordered one on my main account with play, and 50 of them on another one.

There was a pricing error, and they cancelled orders because of it. I'm sure people will still order from them in the future if they are the cheapest.

I have now had an email saying the following

why would you expect vouchers??!!

why would you expect vouchers??!!

Because on a misprice of this magnitude Play have been known to offer goodwill vouchers to compensate for their error.

As most of us think it was Play behind this whole fiasco then there will be no vouchers as it's probably a marketing ploy.

As for mr post no 1, no way did he get a confirmation, he's trying to get your backs up so why rise to it?

i got a confirmation of order then this morning one to cancel, thats what everone will get.

Mine still hasn't been cancelled via email or on my account when I log in, I guess its taking time for them to get through them all :?

Oh, and my quidco for it tracked too?

Got my email from Play this morning stating "Unfortunately we will not be able to supply you with your order at the advertised price and have cancelled your order". I've just checked my order & it's still showing as preordered for £ 9.99 ??

hmmmm my order is still showing too but they said they cancelled it

my order has been cancelled, i was gonna give my bros xmas pressies for the 1st time ever

yep - same one here - still pretty good at £99.99 though

now my friend is a lawyer and she has said that

go back to them - they offered it at that price, you accepted - even if they say invitation to treat (suprisingly a legal term), you offered to buy and they accepted.

This is a valid contract and they HAVE to go ahead with it.

I am going to write a letter to them

They have terms and conditions in their order processes which protect them against miss prices

Got my cancellation e-mail. Quidco still tracked at 40p, will this still pay out?
