    Statutory rights override ANY store policies. It's faulty, so under Statutory law you're entitled to a refund.

    As Tink rightly states, unless you've signed a form to confirm the fault at PoS then it hasn't been identified.

    for any future references to this sort of thing.

    I find that quoting sale of goods acts etc just gets the advisor/salesperson's back up, you need to act as if you know nothing about retail, speak in a calm manner and tell them you dont want to be a pain etc etc, but tell them what you want.

    There are alot of times when you will get the salesperson who will be the brick wall and just say no, the only thing to do there is take their name, the duty and general managers name, and ask for the head office complaints address from the highest person available.

    If they still dont decide to do the right thing, writing a letter of complaint will generally get you what you want, but it needs to be calmly worded. There is no point making yourself look better than them, they have the power to say NO! and we dont want that.

All for being friendly and calm but you must also stand your ground.If you need or want an immediate refund, you stay there until you get one, ask them to ring their head office there and then to confirm the law :thumbsup: None of that faffing about..........

    It's not the responsibility of the consumer to prove the fault was pointed out to them. The retailer MUST provide evidence that the item was knowingly sold faulty. I thought this would be obvious without actually pointing it out.

    As for a store telling you to get out - I've never heard of such a thing. No store would want such bad publicity.

    During a two year stint at a store I used to work for, at least ten customers were told to get out because they wanted refunds and they couldnt have them!!

    It happens I promise you.

    Mind you, I think the reason some stores get tough with refunds is because people take the mick.

    tell me about it guy in front of me in shop today was returning a lawnmower bought 27 june 2008 1 year tommorrow bold as brass said its faulty i want my money back as it was his statitury right364 days after buying it manager was gonna do it but i butted in and told him after such a period of time the store was only liable to have it repaired or replaced manager changed his mind at that point
