    Stop a debtor to leave the country

    I have got an ongoing small claims. The debtor isnt paying even though we met at the court hearing and agreed to pay an amount which was suitable for both parties.

    I rang the debor on the last day he had to pay and said he cant afford it and he will inform the courts and fill in the form to pay in instalments and he hasnt done this too.

    I have filed a form to call the debtor into court for questioning and hoping this will be served soon.

    I now have good knowledge that he has a one way ticket to leave the country as he is in a mess with lots of other financial related problems.

    Does anyone know how I can get an order to stop him leaving and how much does it cost and what do I have to do from now.

    I may be wrong,but I dont see how you can stop him leaving the country-only the police can do that,and this isnt a criminal matter

    pretty sure you can't stop them, this is a civil matter, not a criminal one.

    You can't unless you kidnap him and tie him up in your basement. lol

    There isn't a way (certainly that I am aware of) to stop someone leaving the country who is subject to civil proceedings. Do you know where this person is going? Many EU countries have reciprocal debt collection arrangements with England.

    I have never had to do this (only serve in an EU country) but I am sure it is done via the Foreign Process Section of the Royal Courts of Justice.

    My Inlaws are owed thousands from a certain piece of crap who ripped them off and is now leaving a life of luxury in America.

    Just to also add, there are other methods of enforcement. If you know their bank details you can possibly get a "3rd Party Debt Order" or if they own a property you can attempt to register a Charge.

    If he has no money and no assets it doesn't really matter if he is in the country or not - you aren't going to get your money.
    If you know when he he going to leave, then you might be able to apply to get the hearing to question the debtor expedited. If it is for a large debt it might be worth your while employing a solicitor so you don't risk losing any chance of recovering something.

    Thanks guys, thats the problem he says he has no money where as I know he's just playing on this and know he has the money. He has property so the next step will be to put a charge on his property. I just want to try and get the cash though rather than put a charging order, I may even not live to see the debtor sell his property and really I could do with the cash so I can use it to pay for some things.

    Can British people go on one way tickets to Malaysia? I doubt it.

    It's also unlikely that a person would leave his country of origin for a relatively small amount of money when he owns property.

    CW9652- mr "Celebrity" have u seen how many posts or deals I post, its very low and should I have been posting loads I'm sure I'd have a lot more likes.     Eh? Having a friend who owns a hotel doesn't magically grant you entry to Thailand when you're on a one way ticket entering as a visitor. Or are you saying that he has had a work permit issued?

    Yes it could be a possibility that he isn't going as a visitor and may have a work permit as his friend over in Thailand owns a hotel. This is the info I have. Only time will tell.

    £3k? Just go around with a mate and you should both be able to walk away enough of his stuff to cover that. The way the OP was going on about putting a lein on his house I though at least 10 times that

    Also what everyone said re: one way tickets is true. Almost anywhere outside the EU and they will require a work visa or a return ticket. Even with a work visa they often insist on a open ended ticket.
