T-mobile debt, has been paid but they claim it hasn't- I have no proof!

    Hiya,
I had a contract with t-mobile over 2 years ago. I had one final bill for £40 and I'd cancelled the direct debit as I didn't have the money in my account for that amount (wasn't expecting it to be that much). Anyway I sent them a postal order a few weeks later. That was that. I took out a new contract with them (getting cashback, hence not renewing same one) and that was all fine and dandy- all paid up too.

Now 2 years down the line, I have a letter from them saying I owe £40- the final bill. I then have a debt collection letter saying that they've bought the debt and I owe it to them. I've contacted t-mobile explaining that I sent a postal order, I have no proof of purchase or of sending it off as I threw it away a few months after sending it (didn't think I'd need it). They're saying tough, no proof you have to pay the bill.

What do I do? I've paid the bill once, they haven't received payment (so they're saying). They've taken 2 years to chase me about it, but in the meantime allowed me to have another contract. I'm not happy about paying the same bill twice, as I'm sure none of you lot would be.

Many thanks in advance for any help you can give.

    PS.
Before anyway says, yes I DID send the postal order, I'm NOT lying about sending it! I know there'll be someone who'll try to say I haven't!!

Postal order? Are you for real?

It doesnt matter if you sent it, What matters is did they receive and cash it, if you have no proof they did then you still owe them,

How did you pay Cash? lol
anyway you would need to make a claim via who ever you used, i still know some people who are getting there mail from december

    SuperEd

no proof = have to pay it again

fraid without proof you did, you didn't,
be interesting to try the line
"i owe you £40?, please provide me with proof i do.." though as the law dictates they keep all records for several years for tax purposes they still might have it..

I thought as much. I'm so upset about it, I haven't got another £40 to spend, my total bill will end up being twice the original. I can't see how they would allow me to have another contract if I hadn't paid my first one though?

They weren't chasing for the first bill when you took out the second … They weren't chasing for the first bill when you took out the second contract

Yeah I didn't think of that tbh. Thank you all anyway.

Still worth you bringing this up with them though , as i am sure if you had any outstanding balance when setting up another contract with them then it would of been brought to light when they got your account up !

    A postal order, seriously....

That's what I thought, I've been emailing through to a CEO email address and they're saying tough- you have to pay it. My credit rating is virtually perfect apart from 2 late payments to littlewoods (I mixed up the payment date and the next statement date) and that's it. It's ruined my perfect credit rating, I wondered why I was declined for a credit card recently, but this is most likely why!! I am so upset about it

TBH it's £40, you made a mistake, pay it and move on.

I had to borrow the extra money to pay the final bill, I'd estimated it at about £15, and it was £40 and I was given cash, the easiest way was to pay by postal order- post office is a lot closer to me than the bank is. Yes it's stupid when I look back, but I didn't think there'd be a problem.

I have 2 children and have £700 to pay back on Littlewoods. I don't have £40 to spare atm.

Aww not a nice situation , i would ring them and argue the toss tbh , asking 1- why has this took 2yrs to come to light and 2- if you owed any money to them then why where you allowed to set up another contract !.....and if you do get it sorted get them to correct your credit file , good luck x

I've tried ringing them but they didn't want to know. That's why I emailed a CEO email address, and she's saying tough it's been passed onto a debt collection agency now, and that I have to pay it. I didn't even think to check if the postal order had been cashed or not.

£700 with littlewoods shows that I had to replace my washing machine and tumble dryer over christmas with no spare cash!! I'm not wreckless, I haven't spent it on nice new clothes etc, it was on 2 things that I needed as I have 2 young children.

If you call them up (the debt collection people) and explain to them your situation and due to length of time its taken them to call on the debt ask them if they will accept a goodwill payment of whatever you can afford

apart from that i have other advice sorry

Thank you. I was thinking of calling the debt collectors tomorrow and asking the same. I wouldn't mind paying half, but I feel like they're just trying to get more money claiming they haven't received it. It suddenly arrived before christmas, no other demands/phone calls, and a few days later the letter from the debt collectors.

as far as i know they will take offers just to get it paid off

i had the same with 02, they said i owed them money i paid then about 6 months later get a letter saying the debts been sold on, and started getting loads of letter of debt collectors, called the debt collectors they just kept saying they bought the debt so i owed them the money, i had to keep calling 02 who said they did have the payment on record and will get in touch with the debt collectors, took months to sort out, in the end managed to get 02 to send me a statment saying i owed them nothing

    hope you get it sorted

Thing is, if you was someone else, you might have just paid the debt to keep the debt collector's away so they'd have had twice the money. They're all just money grabbers imo!!

It' not bullying, OP is silly and lives so close to the breadline that they don't even have £40 spare for emergencies, I replied giving them helpful links on how to budget properly.

If you dont make contact at least they will more than likely charge you an admin fee, plus a increase.

Ring them first thing in the morning to freeze the debt and discuss further.

At £40, i would just make the payment before the costs rocket up.

Except legally they are not allowed to do that, its only court that is allowed to add costs like that its different for things like bank accounts where that is in the T+C's.

I live close to the breadline as I don't have much income. I have bills to pay and clothes to buy for my children. I don't go spending willy-nilly. It's not a case of budgeting, it's a case of having more income- which I haven't got. I'm sorry I'm not perfect like yourself!!!

Ohhhhhhhh some right idiots on here. Do not sit here justifying your income here to mummies boys or people who don't have a clue what it's like not to have a pot to pee in.

We are so lucky to be where we are now, but boy do I remember what it was like to have to watch every single last penny, when we were both progressing still in our jobs. It's not nice at all. I'd ask for this thread to be locked tbh.

Take yer oil and pay it again, your fault.
    Be glad its only £40.

I think I will actually. Thanks Tink. It annoys me how people are so quick to judge on here, what goes around comes around. They'll understand one day what it's like!!

I know. My partner's an engineer and he completed his apprenticeship about 2 years ago, he's never had what he's supposed to be paid, and his bosses have told him. He's had to accept a wage a lot lower because of the recession. It pays the bills but we're not left with much. We're just grateful he's got a job tbh.

But back to the subject, I know I was stupid sending a postal order now- I chucked the receipts after 3 months as I thought they'd contact me asking for payment had they not received it before then. And being as it took them over 2 years, it's got me wondering why so long to get in touch.
