    T-Mobile T&C Change - Possible for people to get out of their contracts ?

    Became a T-Mobile UK customer about a month ago..

    As ive seen before people have been able to get out of their contracts if a Terms & Conditions change occurs. Wonder if its possible with this change? If it is how do you go about doing it.. etc

    As Im not too happy about them starting to levy a late payment fee. Pretty sure when i was on T-Mobile before they never did that.

    We've changed how you'll be charged if you pay your bill late and we have to chase you for payment (see point 4.4.4).

    i doubt it though cos if they have to chase you for payment doesnt that mean your breaking thee contract???

    Aye sure – i just wondered based on the actual changes, there is any way people could wriggle out of their contract under what circumstances.

    I would never miss a payment – just seems like a big change to one of the terms and conditions which you could raise an issue with.. Dunno what peoples experience is with getting out of a contract upon a T&C change.

    Without having to pay the remainder.

    yeah interesting but my contract is a web and walk and ive just moved and dont get a signal now

    AFAIK a contract is a legally binding document and any changes to it AFTER you sign it can be dealt with in two ways:

    1. Accept the changes and carry on.
    2. Cancel the new contract due changes in clauses which you are not happy with.

    This goes for any contract - imagine taking out a loan to pay back £100 a month for 60 months, only to find they change the amount to £110 a month later down the line ???

    Has any part of your contract changed to your disliking since you signed up for it? If so, contact the CAB (citizen's advice bureau) who will advise you free of charge where you stand.

    EU roaming prices have gone up – so if you travel abroad you will be paying more than the original contract you signed. This will affect me as i goto France to visit family – which may help me get out of it. Not sure tho – gonna be a bit cheecky to get out of a contract within a month lol.

    where did you find the information that roaming charges were being increased

    If you go down the roaming route you have to have used the service for it to be detrimental to you.
    If not everyone on the network could cancel. . .

    Spoke to T-Mobile - gave me an email.. Said they'll within there rights to up the cost of things not allocated on the contract..

    ie: If they say lowered my mins or texts or up'd the price of text messaging etc..

    But roaming is apparently outside the confines of my price plan so theyre allowed to up it.. Dunno if thats true, wish someone on here with some more knowledge would pipe up

    Each time they gave a different response ie a) it's not part of your contracted minutes so we can b) you hardly call 08 numbers so it's not detrimental to you etc etc.

    I called OFCOM who advised me that T-MOBILE were in the wrong and I should be able to cancel without penalty charges. T-mobile said OFCOM were wrong. I asked for a letter to take it to arbitration (my mind's gone blank and I can't remember the name) but T-mobile refused to give me a letter so I'm now waiting for the 90 day period to expire so I can contact them for arbitration.

    As soon as I get out I'm not going to be going to T-mobile again and will stick with one of the other competitiors from now on.

    Speak to the Citizen's Advice Bureau. They'll tell you what's what (and will agree with OFCOM).

    Next, write a Letter to T-Mobile stating that due to major differences in your contract since signing, you want to terminate your contract with 30 days notice. Send it recorded delivery so it can be verified as being received.

    Finally, wait 30 days and cancel the DD payments you make to them. Keep a copy of the letter. Should T-Mobile chase you for money, simply direct them to the letter you sent.

    Not sure if this is what's advised, but it's what I'd do. Take the onus away from them to cancel the contract and do it yourself.

    i maanged to get out of an orange contract when they changed their terms and conditions to begin charging for 07744/07755 numbers

    i did used to call these numbers a lot, but they said i didn't use it enough

    i disputed by sending letters/phone calls etc, stating that it doesn't matter if i have used the numbers or not, i took out the contract on the understanding that i could
