    Watch keeps breaking- what are my rights?

    Hi Forum. Bought a Citizen watch just under a year ago and over the summer the bezel stopped rotating. I took it into Goldsmiths where I bought the watch and they sent it off to be repaired. It came back about 3 weeks later delivered to the shop. I tried to rotate the bezel in the shop to check the repair and the bezel detached from the watch completely! It was sent away for repair again. When it came back this time the bezel paint (its a black watch) was scratched and chipped off in about 5 locations around the bezel. This time I spoke with the manager in the store and she has informed me that Citizen want to see the watch again. I told the store that I would like a refund or a new watch in replacement. Am I within my rights to ask for this dues to the inconvenience, the bad repairs and the fact it is under a year old? If not, I would appreciate it if anyone could tell me my rights as a consumer in this particular instance. The watch cost £400 (not that the price, but the principle matters)

    yep, u must give trading standards a ring and they will send you a template, which you can edit and send a recorded delivery to their head office and ask them to reply in next 10 days under sales of goods act.

    Legally, the product must be 'fit for purpose'. In this case you bought a watch that you haven't been able to use. If you bought the watch because you needed one with a bezel then you are within your rights to demand a refund as the watch isn't fit for the purpose for which it was intended.

    Regardless of whether or not you need a bezel, I would argue with the shop that paying £400 for something that you haven't yet had the chance to wear is a bit ridiculous, & ask them for a refund or a replacement.

    Don't shout at them , call them names, etc, just be polite but insistent - you spent a lot of money in their shop for a product that is clearly faulty. The contract exists between you and the shop, & it's up to them to put things right. Don't let them fob you off with "you need to deal with Citizen" - you don't, you bought the watch from the shop & it's the shop that is responsible for putting things right for you. (You could always suggest getting Trading Standards involved.)

    This is quite irrelevant. You bought something with an advertised feature and that feature fails to function. IT doesn't matter if you needed or wanted it, it just doesn't work and it should. Otherwise, the advice above is sound. Good luck.

    Many thanks for the input. I have already told them that I want either by money back or a replacement. The manager was busy (surprise, surprise) and they would get back to me. I think the "suggestion" of getting Trading Standards involved is a good idea and I have just read the 1979 Sales of Goods Act and it is quite clear about everything. Goldsmith's said they would ring back today. I will keep you informed.

    Yeah.

    Had a similar issue myself recently - got advice from my colleagues at TS who work in the same office - rejected item as they failed to repair - got a replacement.

    Yeah, I didn't word it very well - I meant what you said, but was quoting from my law studies.
