What's the crack when delivery driver damages ebay item?

Sold something on ebay that was in fully working order, i also stated pick up only, lady who bought the item arranged a pick up by DHL, i didn't box or package it up because it was too big and i didn't state that when i sold it on ebay.

Now i get an email back from the buyer saying that DHL are sending it back to me because they have broken something of it and will not deliver to the address i provided. Now the lady is stating i need to phone DHL up, also i need to claim for the item and they will claim for the delivery cost's but i never wanted delivery only pick up from my house!

Am i libel for this? what should i do? just leave it or go through the procedures of the claim etc?

Oh and DHL state that they will not take anything that isn't packged/boxed etc yet they have still taken the item and broke it!

Oh dear, you sent an item completely unprotected, they may not pay out and as far as I am aware, you can't claim twice, she would claim for the whole lot as she arranged the delivery, how it is with the couriers I use, not sure on DHL, so she will get the refund on the item cost oh and she would win an INR, from paypal too as you cannot prove delivery, bad times.

If you say collection only stick to it and NEVER allow the buyer to arrange a collection for you.

looks like you are gonna either have to await the claim or if you have sold it to her then its in her name isnt it, so should be her problem, maybe contact ebay? Good Luck!

Why did you let them take it in the first place. No good saying you didnt want it picked up... then allowing it. As for not wrapping it.. again you should of if you allowed for DHL to pick it up.

Sorry to be the bearer of bad news m8... but you gotta take this one on the chin. Bummer i know... but you should never of allowed for collection if you stated pick up only :-(

EDIT: OK she arranged delivery so she would have to make the claim. I dunno how this will stand with ebay/paypal though. If she puts in a dispute you might be knackered. Sticky situation.

Lady who arranged the DHL is the key here, she has the contract with them and not you, I would have nothing to do with it, and let her follow it up. Give her as much help as you can but stay away. Do you have full payment? Did you pay for the delivery? If you have no costs outstanding there is no need to get involved

Erm yes there is a huge reason, lady contacts DHL, claims and gets refund, she contacts paypal wins an INR as the item has not been delivered, so op looses money and has a broken item to boot, he is gonna loose out here, he should never of sent it.

Yes well as far as i'm aware i myself don't think im libel for anything because i clearly stated 'free delivery' and in the notes i quoted 'pick up only'. I also have an email stating 'what should i do about the item as i have not packaged it up', reply came back saying 'don't worry about that'.

Now once it leaves my property it's in her hands i would of thought, i have all the mails and DHL pick up invoice as proof.

One more thing, the lady still wants the item anyway and will fix it.

DHL rarely pay out even if its dealt with by the book,packaged correctly etc.

You are responsible for getting that item to the buyer.

OP unfortunately you are going to have to put this one down to experience imo

Just hope she's honest. Paypal follow the rules to the letter..........no item, no money for you. This isn't all that rare and is one of the known scams.

Paypal will find in her favour if she makes a claim as it all comes down to you say, she say and as the buyer they will side with her.

Re-sending a broken item probably lol

Reading this again,I would wait for DHL to bring the item back to you and just refund her.....will save a load of hassle,resell it strictly for collection only

She is shocked because if you knew ANYTHING about your liability you would never have sent this item totally unprotected, YOU are responsible for getting the goods intact to the buyer, no matter how many disclaimers you have. You should have refused outright to send it, but you know for future ref.

If the buyer puts in a paypal claim saying it didn't arrive, the seller can't prove it arrived buyer gets a refund regardless of any circumstance.....if you have the tracking number from the buyer,you can prove it arrived, that will be on the receipt the courier gave you,,, so there is your delivery proof! the next step will be a paypal claim for damage ,the buyer must send it back to you for that claim....that's the point you need to be clever with how you deal with it.

Exactly my thoughts... buyer claims through paypal, which she WILL win... also she claims through DHL. She gets double you get nothing :-(

That means nothing though..........it doesn't adhere to their terms so is null and void.

As for criticism, you asked for advice and we are just telling you how they deal with it.

How do u package up a bloody kids ride on jeep? tell me? do i dress it up in wrapping paper with a bow? it would cost £20+ for the packaging and p+p.

That's why you should have stuck to your guns and not sent it. Something is amiss here I feel with the buyer, I know if somethinglike that for my kids was broken, I wouldn't want to repai it, safety and all hmmmmmmmmmmm.

You shouldn't have let a courier pick it up if you weren't prepared to package it up.

I agree with others i'd just get it back and refund her.

Because DHL won't deliver it and are returning it, so the buyer says.

Trouble is i wasn't here for the pick up, the driver even stated we don't take things that aren't packaged, if i was there i would of said no. I only got the email from the buyer on the morning saying that the delivery driver was coming that day, i had the school run, tidy the house and shoot off to work so my head was in the shed, i really was in a tizz and not thinking straight i suppose haha!

Bloody christmas time!! very stressful :-D

Op this is quite important info really..........with regards to if the buyer is genuine or not.

If the buyer still wants the item, how do you propose you are getting it to them?
