    Why is sicpuppy banned?

    I wanted to buy something from this user, just wondering why he is banned and how long for?
    Could a mod please let me know if possible?

    We have an infraction system which records any misdemeanours, plus we can make user notes on everyones account.

    We have to at work as we take notes on regular customers, and they can legally ask whats being held about them, so we cant write "annoying gimp child that looks like a monkey" as they can request their info, read it, and not be best pleased. As well as info held having to be relevant, and derogatory comments like this arent relevant so also a breach.

    Yes, as long as you ask in written form. By law you're allowed to see them.

    My work we dont have any personal data, often just nicknames and a brief description, but its a tricky field and even though theres no actual name, address etc you can still figure out who they are so they have to be given the data.
    We only have a nickname, and still get warned not to put anything cheeky in it, so if it came to it, the law generally side's with the person requesting the data.

    The only people with usernotes against there account are those who've broken a rule and received an infraction-
    It shows the date the rule was broken, the offence, and the punishment given.
    It's nothing controversial and doesn't contain personal details...
    If you've received a yellow or red card before, or a ban, you'll have usernotes against your account stating what you did wrong. You'll obviously know if you've been banned/infracted before and why, so that's exactly what will be written in your notes.

    It's simply to help us keep track of whether members have broken the rules before so we can assess what ban length to give if they reoffend.

    How do I appeal a ban?

    I PM'd a Mod asking them to check something and let me know if they had any issues and then was banned, me thinkgs this is not the best approach....

    Ok so do I dont want to appeal but think the decision was crazy.
    I could still use the site I just couldnt contribute, very bizarre as wouldn't you want to discourage that?

    As much as I like this site I think the modding is over zealous and inconsitent.

    Don't worry Taz your in good company, it seems that to be a regular trader and contributor nowdays you need a ban in your profile.

    FAO Mod's - it does not matter if the notes held about us are personal or not, if requested you must provide any details held about us for us to view at any time given reasonable notice. Failure to do so gives the requestee the right to report you to the UK data protection information commissioners office where you will most likley be served with a notice forcing you to produce the information to the individual.

    If you are involved in storing information about individuals no matter how insignificant I would speak to the ownes of HUKD and get information because as a moderator you have access to personal information (DOB, Emails etc) and clearly you are keeping notes about people. Technically in terms of the DPA you are a 'Data controller' which means you are responsible for complying with the DPA, and you and your company are liable for non compliance to the DPA.

    I suggest you look into this further.
