Why is this user still allowed on HUKD ????

Why is phproxy still allowed on these forums ? Why aren't they banned yet ?

I purchased an item from them and they never sent it and yet still have my £25. Paypal has found in my favor but was enable to recover any monies from them. I have printed all documents and i'm taking them to my bank and try to recover from paypal now.

If i am unsuccessful with that i will start legal action against phproxy aka xxxxxxxxxxxxxxx

Then its your word against theres basically, you cannot expect HUKD to start banning members on others say-so, all you can do is leave feedback to warn others

where is the thread for the sale? i trust you agreed to pay for recorded delivery?

    Banned

hotukdeals.com/for…314 this is the thread, so he says he sent it, you say you never, of course the seller didnt send it recorded, thats why paypal went in the favour of the buyer

    Banned

A classic example of what happens when you do not used a recorded mail service. buyer can chargeback from paypal even if goods arrive and seller can say he posted when he didnt. I am not commenting on either party in this transaction though.

    Thanks sassie

As above, unfortunately in this case it's your word against theirs and exactly what the feedback system is there for...

If you buy ANYTHING from the net, either directly or via Paypal - USE A CREDIT CARD.

think it is really ufair of you to take this out on HUKD, you know the score

I always put on my sales ebay and soon here that if item sent standard mail doesnt arrive i email buyer copy of proof of postage and form sent to make claim with royal mail. sometimes royalmail send out a form asking them to declare the item has not arrived. As soon as royal mail declare the item lost and send me refund i then refund the buyer. this way if they did recieve the item it is royal mail they have stolen from not me and i havent lied to royal mail they have.

I doubt the seller was capable of taking credit card payments :?

Personally, I wouldn't send any money to a paypal account that was not verified.

I think he meant use a credit card to fund paypal - some CCs will cover this, other treat it as a cash transaction.

Leave him feedback calling him out and if anyone has any sense they will avoid him in the future.

that odes not cover you in a paypal claim, if buyer cant be bothered then they just do a chargeback and leave you to sort that out, it is always a sellers problem till it is received by the buyer

Phproxy may well have posted the game. The RM do lose a lot of post in my experience.

It was both parties fault that they did not insist on recorded delivery.

The best solution is for phproxy to refund half the £25 IMHO.

Very true. Paypal will always award in favour of the buyer unless the seller has proof of delivery. Proof of postage isnt good enough.

paypal are useless, the only way you are covered by them if the buyer decides to lie/cheat... is if you send to a buyer with a confirmed address, in the UK, you have sent within 7 days of payment, it's an ebay transaction or similar, you have proof of postage, signed acknowledgement of receipt (in case of goods over £150), and a few other conditions as well....and even then....after tons of emails back and forth requesting the information and maybe after at least 6 months...... So it's a big long fight on the sellers part to recover the money if they come across someone who makes payments with paypal through Credit Cards .....Confirmed Address or not confirmed...... The best people to sell to are people who have a good feedback history for relitively expensive items

If this is clearly stated in your terms and conditions of sale for public viewing then paypal fully support this. I have had 4 claims and paypal did not refund they had the details of the sale and copies of the claim with royalmail and i refunded buyers when royalmail refunded me. 1 of the buyers refused to sign the declaration from royalmail and paypal found in my favor.

As mentioned by Sassie Paypal will find in favour of the buyer. It is very disngenuous of some ebayers to say postal losses have nothing to do with them. If I was a buyer and you sent me a claim form and told me to sort it out (no matter what you had put in your postage information) I'd just make a paypal claim.....you have the contract with Royal Mail, you paid them the money.

no i would send a copy of the claim form i send to royal mail

So basically paypal is good for BUYERS using Credit Cards

but bad for SELLERS if any problems occur - especially with buyers using Credit Cards

sorry dmissy13 i agree with gari189. i wouldn't care that you'd sent a copy of the RM claim form. i'd still lodge a complaint against you with paypal. the onus is on the seller to use a signed for service. if they don't and it doesn't arrive its upto them to refund the payment and try to recover from RM.

I understand why you would do that but just letting you know that each time paypal has found in my favor and not awarded a refund the the buyers

Thats very surprising as it clearly states that proof of delivery MUST be provided in the event of a claim by a buyer. Clearly, if they have found in your favour, then they are breaking their own T&C's.

Still - it is paypal we are talking about!

proof of postage is not proof of delivery, and to be honest if you refunded the buyer then ho do you work out that paypal was in your favour :?

I sell on ebay and always used to send recorded or next day delivery (at cost) but following feedback from buyers who wanted to pay less I now offer a bog standard "I'll stick a stamp on it to cover the postage..." service. Are you saying that if Royal Mail lose it or the buyer receives it and pretends not to, despite the fact that I clearly warn them that items sent without insured delivered are at the buyers own risk, that I'm liable for the claim?

yes you are, why would the buyer be, i cant even understand why you think it would be, if you ordered stuff and it didnt arrive what would you do:?

Paypal will not reund you if they ask the credit card company to reverse or call back the payment...as you won't have any proof of delivery (signed). This is quite bad for sellers with expensive items. So always sell to confirmed addresses - to have the possibilty of being covered by Paypal Seller protection policy and also use a delivbery service that allows for tracking and proof of delivery i.e. signing on receipt

i thought the original deal was £25 for the M3 inc recorded delivery, if the seller has no proof of this postage then he's the one in breach of the transaction details and should be banned if he can't prove postagte to HUKD

HUKD does not make any guarantee as to the trustworthiness or condition of any trades on here and we do not validate the listings on here. So please trade cautiously, follow these rules closely and understand the risk factor involved in any personal trades.

Has the seller come on and said anything here or has he stayed silent throughout?

He was merely pointing out what he saw as a flaw in the system.

im not sure what you are getting at, there is no flaw, you can put in what you like but when it comes to paypal the buyer will win if the item has not been received, unless the seller can prove it has been
