    working flexible hours

    hi im due back to work in april after maternity leave and just wondering if anyone knows how the flexible working works, im going to have to try work around my partners shifts as i dont want to put my baby in nursery we want to look after her ourselfs. i work in a care home so the shifts are quite flexible anyway but they can be funny buggers at times, im thinkin of writing them a letter to purpose what shifts,days, times etc i am able to work also i want to go back part time not full time, can they turn round and say well thats no good to us and basically not give me a job or have they got to come to some sort of compramise. ideally id rather stay at home with my baby but at this time i just cant afford to.

    It may look a bit formal, but i would imagine that youre employer hasnt got much off a clue off what you are entitled too either. When i worked in a residential care home all the women came back to work on reduced hours, they would just state what regular hours they could do and everyone else worked around that!

    surely that is discrimination for those without kids :thinking:

    Usually discrimination in this context is for when there is no reason to do what the employer is doing (the actual discrimination).

    The person is trying to be helpful but they are not doing a good job of it.

    You can ask and they have to consider it but they don't have to accept it and can just turn round and say that it is not suitable for them - you then have the choice to either go back to work on your normal hours or you resign

    i think they will say its no good whatever i say thats what worries me, as over the past year they have got rid of so many staff and people have walked out etc, i think they will just say no so then they dont have to take me back as they are having money problems and cutting down people hours now, but i can only try and hope for the best.

    You just need to make sure that your proposals for new working hours are reasonable. As soon as you hit them with a slightly unreasonable request they will just say this it is not suitable to your work. If you go in with a reasonable suggestion and they then do not accept it you can then have a chance of seeking advice from ACAS and potentially getting your request accepted.

    ive worked there for the past 6years and they have always let 3 girls start at 9 o clock and finish at 3 to drop and pick up there kids from school instead of starting at 8 and finishing at 5, so if they were funny with me i was going to bring this up as it always left us one girl down in the morning for the busiest hour till they arrived, but these 3 girls no longer work there so they will probably say well weve changed our rules or whatever.

    That above seems reasonable. We have ladies doing the same at our work. Residential car home work is very hands on. Working hours and suitability are always going to differ.

    Go in with a proposal and then try and negotiate to what is best for both parties.

    As you say, can you afford to not be working at the moment.

    Your best bet would be to try and get a work friend to cover the hours you don't want to work. Your proposal would then not effect them and so could be considered unreasonable for them to refuse.
    Anything you suggest can be refused if they can prove it has a negative effect on the business.

    That doesnt always work because:

    1. Being suitably qualified
    2. Working in excess of maximum hours
    3. Level of pay

    Still, worth a go.

    Like I said "could be considered" not would be considered. If they don't want to give the hours you require all they need to say is it isn't suitable for the needs of the business at this moment in time and give a reason why. It would then be up to you to prove it would not effect the needs of the business. You are probably on a hiding to nothing but worth a go before quiting. Remember you are easily replaced by an agency worker who would probably be crap at your job.
    Our Government are great aren't they. Just remember that you are only a worker ant and they don't care about you, they just pretend to so you vote for them. They will skim the cream while you get the left overs and are expected to be happy with it! Then they'll fine you for filling out some document wrong or going 3mph over the speed limit, more cream for them.
