would this be classed as "entrapment?" legal/police advice!

Found 10th Jan 2009
Dropped a relative off in town and was waiting for her in a "clamping" area when a "clamper" tapped my window asking me to move on. Before i was able to start the engine and move off a second clamper drove his car behind mine to stop me reversing out of the spot i was at.
Clamper no.3 tried to Clamp my car!

Anyways i managed to just about drive off before the clamp was fitted, and was very pieced off.

Surely this would be classed as "entrapment?"

Trapped - but not entrapment!

cant be classed as entrapment, you where in a clamping area already and they didnt entice you into it

I wonder if their actions would have been the same if it was a car full off brickies or army lads.
I think not. Is that a test of legality?

No wonder they charge so much for taking the clamp off, they need to cover the wages of 3 clampers in such a small area. :?

what you're sying is that if you go onto a car park where they can clamp you, the clampers can block the exit/entry and clamp your car?

I would say harassment as opposed to entrapment, it is easy to take a wrong turning into a carpark for example.

they where already in an clampable area, had it been somewhere you are allowed for 2 hours then clamped and the clampers drove behind to stop them going at 1 hour 55 minutes then yes

id have got out and beat the carp out of with their clamps!

I would seriously get onto citizens advice make a example of them because it could happen a lot worse for someone else.

also i am pretty sure if it is an obstruction and they are patrolling the land they have an obligation to help move you to a safe location if you are in the car, especially if they told you to move on as "contractually" you were advised to move on so you could say they were endangering your safety by altering your vehicle while you were in full control of it and it was without your full knowledge or consent.

I seriously would investigate this further could get harassment money there

don't quote me on the legal bit a because they recently changed the European clamping laws and it is all a bit different was meant to be for the better but i am unsure on all the bits

hope this helps or at least spurs you into making a stand on pushy clampers

i would of started horning loudly would of caused a lot of attention and surely they would move. must of been scary if you were by yourself.

Intimidating behaviour, and there were 3 of them?!? Were you parked outside Buckingham Palace? Or were you parked on the double yellows outside the clampers yard :w00t:

Interesting, if you are in the car and they clamp it, is it kidnapping? They are enforcing the restriction of your movement . . . .

*note:
ask "TRIAD" for movie "entrapment."

Thanx for the recommendation

From a police point, there are no offences here. By parking on at this location which i asume is private property ( as they have contractors clamping vehicles ) then you agree to their terms and conditions. This behaviour is not at all unusual and police and CAB recieve several complaints about this sort of thing as clampers are more often that not rude, abusive and intimidating. They would of been within their rights to clamp you
