    ZAVVI ARE AT IT AGAIN!!!!!!

Guys I am furious! I have just spoken to Zavvi having ordered the Logitech Racing Wheel for the XBOX360 which was on here a few days ago at 17.95.

Guess what? They only had 'limited' stock and wont be honouring the order - even though we all know their website updates realtime so they did have stock when I ordered.

The girl reminded me that they can cancel an order at any time for any reason and I reminded her that this kind of activity was why people stopped buying from them in the first place.

If any one else has had this experience recently, can you add a quick note as I want to make sure that others dont fall into the trap.

She offered to send me one at 49.99 which I politely offered to shove up her a**e!

Whew! Feel a bit better now but I still have to explain to my son he's not getting his pressy

Thanks for that I'll take a look. I want to wait for Zavvi as apparently they seem to have taken the payment (doesnt this constitute a contract?).

Any chance you live in Birmingham? I bought one but after using it once realized I'm probably ever actually going to use it again.

So they didnt have any stock yet they could sell you one at £49.99 , chancers

no not with distance selling rules there is almost certainly a stipulation stating that the contract is formed upon dispatch of goods and they reserve the right to cancel at any point up until then.

Yeah - and they did this to me twice before they went bust - always on 'sale' items. I wondered since they are now under The Hut, that they were sharing stock with their deal and oversold.

    Found this:

All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order.
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit or debit card or (ii) dispatch the goods to you or commence the services, whichever is the earlier.

It shows that they would email me if not available - they didnt do this, I was watching the order status as I suspected a rat after it sat at 'waiting for stock pick' and then had to phone them.
    (i) debit your credit or debit card or (ii) dispatch the goods to you or commence the services, whichever is the earlier - so technically a contract was formed and they were in breach. TBH dont care anymore but wanted to make sure others are aware.

i would call them and make them aware of this. you may get your wheel after all so yes you are in the right by the looks of it.

Really sorry you have had to post this I have read all the threads, I work for Zavvi can't find out who you have spoken to please call us again.

    Hi Vayder,

have PM'd you but posted here as well....

in the end I have cancelled the order as I was furious. I understand that things get mixed up, but the terms clearly state that if the item is out of stock then I will be notified, but I had to call - no emails accept the order confirmation.

I made the call on Thursday 23rd July at 13:03 and it lasted 5 minutes. I didnt get the name as I was so mad. I have now(today) confirmed that no payment was taken, but the website does work on realtime stock and showed in stock no problems.

I want to do my bit in supporting healthy competition which is why I decided to try again the 'new' Zavvi, but I am sad to say its a similar experience to before. If you really can make a difference please let me know and I will be happy to help Zavvi learn from the experience and hopefully stop someone else getting this unfortunate impression.

Thanks Jetpac hoping other poster can help. I have cancelled the order as I was so angry and my card issuer advised this to ensure that payment wasnt taken or if it was confirmed that it would be refunded in the shortest time.
