WONGA REFUNDS DUE

Hi all this is just a help post for all those that have had Wonga or similar loans in the past.

In case you have been living under a rock you may not be aware that wonga has been approving loans which were unaffordable.

DO NOT CONTACT COMPANIES OFFERING TO HELP WITH THIS

All you need to do is send a couple of emails and the refund will be issued to you

1. Send the email in post 1 to customercomplaints@wonga.com (the reply may take 8 weeks, mine was 3 weeks)

2. Send the email in post 2 to the same address amending it to reflect your circumstances and deleting the help quotes.

You should receive a response fairly quickly this will detail your refund if any plus 8% statutory interest.

3. If your happy with the refund amount reply to the email as detailed in the email.

4. If not happy refer your case to the financial ombudsman at

The Financial Ombudsman Service

Exchange Tower

London

E14 9SR

Telephone: 0300 123 9123

Email: complaint.info@financial-ombudsman.org.uk

Website: financial-ombudsman.org.uk

Enjoy your refund

Note if you have previously had a loan written off then this will be taken as part settlement.

I calculated I was owed £2000 I had £1300 previously written off and was awarded £700 plus interest.

Hope this helps somebody

Wow.. parasite!? But harsh don't you think? Don't think there's any need for that

To be fair I don't feel sorry for Wonga at all as they are parasites themselves, preying on the needy/stupid/desperate (select your own on your political and social view).....

Its a nice brucie bonus for those that have been needy/stupid/desperate enough... I hope that it helps them get more stable and not need to resort dancing with the devil again...

Wonga and the like are clearly the devil.

I have had x loans from you between date and date. [if you don’t have a full list say “You haven’t yet sent me the list of my loans, but I borrowed a lot from you in 2013 and 2014, or something like that”]
I have been borrowing more often and the amounts tended to go up. Your loans trapped me into a debt spiral, with the repayment taking so much of my wages that I had to borrow again to cover my next month’s living costs.

For this period my income averaged about £x a month.

[If you have a family, add some details eg We have two small children, both in nappies for much of this period. We had child benefit and credits which averaged about £x a month.]

My living expenses were roughly: rent/mortgage £x. Council tax £x. Utilities and bills £x. Transport costs £x. Clothes £x. Food, toiletries, nappies £x. Child expenses £x Other debt repayments £x. Total £x per month. This shows that there was no way I could afford these loans. When I repaid them, I had to borrow again to get through the next month.

[“Bills” includes gas, electric, water, TV, broadband, phone, insurance costs. Put all car and commuting costs under “transport costs”.]

You should have realised from the number of times I rolled loans or borrowed again that my loans that my debt problems were getting worse and it was not responsible to continue to lend to me. [Add more details about how often you borrowed or rolled loans, how the amount went up etc]

[Include/change this if your credit record would have shown big problems: My credit reports would have showed my other debt repayments and problems including late payments / defaults / CCJs / debt management.]

You should never have given me these unaffordable loans. I would like to ask you to refund the interest and extra charges I paid. The Financial Ombudsman suggests that statutory interest is added to this sort of refund.

[Include this if some of your loans are over 6 years old: I only found out I could make this sort of irresponsible lending complaint in month/year. I understand the Financial Ombudsman will consider all my loans, including those that are more than 6 years old.]

So if they wrote my loan off is this still worth doing?

The wrote mine off but they still paid nearly £800 extra for loans prior to the one they wrote off. It would be worth sending the first email and getting a statement of account and working it out from there. Even so it's worth trying as it costs nothing either way.

Aren't you being a bit.. narrow minded?

He's clearly taking advantage of the fact that you can get a bit of money back from them, by pointing the finger of course.. but that doesn't mean he's a parasite?

Is Wonga funded by the public?

Sometimes it is the only option which is exactly what the loans are designed for. Yes it may be 000% Apr however it doesn't get to that amount as it is monthly. Tbh they are quite reasonable if you look at a monthly basis of e.g. Borrow £100 pay £115 after a month

thanks for this, my son had one debt written off by them in 2014 IIRC. Looking back he had about five off them and they knew full well he couldnt afford to repay as did all the others he borrowed off. Apparently they dont do credit checks because if they did like most banks do he wouldnt have got a loan off them. He is in serious debt now due to mental, gambling & drug issues and I'm dreading the day bailiffs come a knocking as we both have the same name so hopefully if they do refund that will go towards his other debts.

I've had loads of loans from wonga, all paid off in full but some were paid late. I'm interested in doing this but I put down on my wonga account that my earnings are £1600 a month and I have very little outgoing payments. This was of course a lie so I could get the loan, I didn't want to be rejected as I needed the money.my question is how can I tell them they have been lending irresponsibly to me, when to them it looks like I can afford these loans. I lied about my earnings so it's my fault. How can I say I couldn't afford it?

Hi. Yeh if you copy and paste the first post into an email and send it to customercomplaints@wonga.com they will send all the details. Add up all the fees and interest then minus any loans that were written off. Add 8% statutory interest and keep note of the amount. Count up how many loans you had in total (not just before 2014) then fill out the second post and send it off they should then come back with an offer. If it's the same or more than your calculation accept if not then go to the ombudsman.

I got all the loan information from my closed accounts on my noddle credit report and sent a copy with the second email. I hope this will speed things up!

Please refer to Section 77 of the Consumer Credit Act as per Subsection (3) of Section 77 which states that the requirement under “Subsection (1) does not apply to – (a) an agreement under which no sum is, or will or may become payable by the debtor…”Is this right, can they refuse to give me details of paid off loans?

As they have refused just go straight to the ombudsman.

So the one hand you claimed they 'trapped' you and on the other you say their loans were 'quite reasonable'.

I fully understand how/why Wonga find themselves in this position, but I can't help thinking your behaviour is not much different.

The 2 rulings mentioned below don't seem to cover what you have managed to achieve. I'm not doubting you on this, I would just be interested to see. This is the compensation for using unfair and misleading debt collection practicesand this is the writing off of 330,000 loan BALANCESAnd re-thinking by initial thoughts about your behaviour, if it's being offered to you, you would be crazy not to opt for a refund in any guise.

Whilst I agree with you with respect to taking the refund if offered. There apparently has been cases where wonga have offered to refund loans 3-6 totalling £500 however upon going to the ombudsman it has been ordered that wonga refund all loans some people were offered £500 then went in to receive £5-10,000

    Read here https://debtcamel.co.uk/asking-wonga-refund/

Here is the link to the affordability checks. https://www.handbook.fca.org.uk/handbook/CONC/5/3.html

I may be incorrect about wonga as I can't find the fca ruling so it may have been an internal decision

    http://www.thisismoney.co.uk/money/article-2691371/Are-payday-lenders-cleaning-act-The-Money-Shop-refunds-700-000-Wonga-axes-cuddly-puppets.html

However quickquid has certainly been ordered by the fca. https://www.fca.org.uk/news/press-releases/almost-4000-customers-due-redress-totalling-%C2%A317-million-payday-firm-casheuronet

It may be the case that wonga has decided to do it off their own back rather than being forced.

Whilst I can now appreciate the attitude 'why not', did your borrowing from Wonga cause you any undue/unexpected hardship? I do understand that irresponsible lending is bound to lead to irresponsible borrowing, but not in every case. I just can't square the circle when it comes to an irresponsible lender lending to a responsible borrower. That scenario is possible even with Wonga

It did at the time however I managed to break the cycle although at the time I was hardly eating, behind on rent etc etc

What I'm saying is that Wonga's business model was completely … What I'm saying is that Wonga's business model was completely irresponsible. That's a fact. However if someone researched at the time and only wanted to borrow £100 for 30 days with interest charges of £15, you might well find the only places that would lend £100 for 30 days would be Wonga (for discussion sake - another similar company is possible of course). Now let's take a scenario where someone has a £80 parking fine that unless it paid for within 14 days will rise from £80 to £160. Suddenly the Wonga loan is a good (responsible) option for that individual (they'll get no change pleading with a parking fine collection department)If the above transaction was executed and the £80 fine was paid, and then in 30 days time the £115 was paid to Wonga and that was the only loan ever made by Wonga to that customer, do you believe that customer would then have cause for claiming their money back from Wonga because Wonga lent irresponsibly?

All power to people claiming anything that they possibly can from exploitative companies like these.

People please try and avoid using pay-day loans, they're death for your credit score and will just compound financial problems you have.

Putting numbers into the equation doesn't make any difference. You agree Wonga lent irresponsibly, then expect people to have no recourse?

The people they are lending to are vulnerable people. Some of who are not able to research such things. That's why they are vulnerable and should not be lent to. Banks wouldn't.

Just reply something along the lines of my credit file is not relevant as it has obviously changed since the time of the loan and that you do not have access to your bank statement as you have changed banks. If they come back with some excuse take it to the ombudsman.

I am still waiting to get the email from Wonga. Some of the other companies have got back to me with the statement of accounts. So for those ones I have sent the second email, and I have worked out the interest paid is about 8k, so that would be great if they will pay back some of that. Hopefully Wonga will get back to me soon.

Just want to thank the OP, as this could seriously start to make my credit rating increase.

I just got my first one sorted with 247 money box. I was going to claim for £192, but I also had an outstanding balance of £180. So would have been £12 I would of actually of claimed for. However instead of sending the second email, the response to the first email was that they would as a gesture of goodwill they would write off the existing £180, and remove any negative traces regarding that from my credit report. So I decided to accept it. very happy. Just the other ones to go now.
