Firstly, your post highlights my exact point. Some people would like to know why they have to wait 7 days max to get their money back, Others would like to know whether they have any legal/moral standing to get the phone. While you and your like are simply trolling and wumming.

As you say in the days of early internet shopping, I'd have said the same. No consipiracy theory...simply a human error.
But today there are sophisticated systems in place to prevent such errors appearing on a live system (you only have to look at how HUKD has developed as a site), these warnings would need to be manually bypassed to post such an offer to the Argos Website. Just like using Antivirus software, live monitoring systems are in place (or available) to prevent fraud and multiple ordering taking place - suspicious transactions etc. Prices are live checked against comparitive companies.
Leaving this offer up to tempt strengthens the case for people who have an order number.
There is no excuse for the offer to remain online. Its almost like Argos are sticking two fingers upto the law book, and saying we're watertight on this - we'll do what we want - its our website.
Advertising Standards, for instance don't cover Company Websites. You can't complain to Advertising Standards about misleading information found on a Company Website. The Internet is only very loosly controlled, to prevent the very worse of stuff from appearing.
As companies understand the technical aspects of the systems they run, they get to see how little 'grey' quirks, cause massive spikes in traffic, or publicity to their advantage. They get more confident in using them. Having an influx of new website registrations is very helpful for them. Argos do 40% of their total business through their website.
Here's your remit:
New catalogue out, Nokia Lumia Phone we need to sell (Microsoft have stated they are now offer incentivised terms). Need to increase number of web account signups.
Its very obvious it isn't 'simply a human error', this is a dangerous game of playing very close to the wind, to promote Argos and in this case Nokia/MS.
There is no doubt that the Nokia Lumia needs as much publicity as possible because the general public just haven't being interested in WP7 to the same extent as Android and iPhones. Phones are about ecosystems and being late to market WP7 isn't as well developed as phones such a Android and iphone. Without an ecosystem you can't sell WP7, without Developers you don't have an ecosystem. WP7 needs hype - any hype for that matter.
I think the consumer law is moving away from siimply accepting 'human error in the supply chain' - misprice etc, its just not acceptable from big business any more.
Just in the same way, its no longer acceptable to drive your car with no insurance in the hope you won't get caught, there are systems in place which mean you probably will be much quicker than you think, if you are - you don't argue you accept and move on.
Argos were caught out, their systems failed them, its there fault. They should learn from it, honour the price and move on.
By not honouring it, Argos are opening themselves up to a host of other problems, getting all your deals voted cold on site such as HUKD will cost them a lot, lot more in the long run. M&S looked at it logically, and said what the best outcome here - supply the product at the price shown. Move on.

Bloomberg are reporting today that Nokia has sold over 1.3M Lumias in its first quarter. They could not supply enough stock to meet demand. It was also the biggest selling phone in Germany, Holland, Russia (and quite a few other places) and is the fastest selling on Orange.
There is a proliferation of "not selling" stories on the web that all seem to derive from one source but I'd rather rely on Nokia and Bloomberg as opposed to some Apple fan's blog for a source of sales information.
The point is that the Argos price was simply a mistake and could not be argued to have been heavily discounted to shift a failing phone.
I suggest you turn off your caps lock and move along.

Anyone who paid by card hasn't had the money taken, it has been ring fenced and that ring fence will be lifted soon enough. If you paid £119.99 by PayPal and they have taken the money, you'll get it back in a week or so. It's not like you would have been using that money for food if the punt had paid off. In the current economic climate, it's not like you would have been gaining any interest on it.

Well that goes both ways, for starters you have come onto an expired post to tell people to get a life, kinda tells us that you have nothing better to do, and in fact you need to get a life. People have reason to be annoyed and complain, but i personally think your angry that you wont be getting one!
When times are tough it is the retailers that build up a rapport and who create a brand loyalty thar will survive.
Argos have let themselves down badly and need to address the situation and put things right.
I am not expecting them to honour the deal but the least they can do is treat their customers with courtesy and a modicum of customer service.
