Ebay and Vero Rights

Hi everyone,

A few months ago, I put two Clarins creams on ebay and my listings got pulled because of Vero or something or the other.

I've just had a chat with ebay and they said feel free to put them back on.

If I put them on, will it be okay?

I'm a private seller and the creams were a free gift with purchase.

Thanks to anyone who can help.

I went through this couple of years ago when selling perfumes - my listing was pulled twice and a third time would have meant account suspension for a few days. Worse, there was zero help given on what exactly was causing it. Through trial & error, I removed words like new, genuine, sealed, etc from just the title and I haven't faced any problems since. The listing attribute fields still contain all the information required so that the buyer knows what they are getting.

eBay has to enforce Vero or it would be flooded with counterfeit goods and stories of customers being poisoned by fake cosmetics containing lead or arsenic wouldn't do their refutation any good.

Vero can lead you to a banned account if you list and sell to contravene their rules. There is a very clear list on Ebay of companies that are in the Vero programme. I have two trademark ownerships (nothing major) which means I am in the Vero programme. It prevents peeps selling under that 'name' and with an account manager (even though I no longer sell on there - haven't done for years) it does mean that any Vero issues are dealt with quickly.

My best advice would be to comply. If an item brand is Vero'd then don't sell it if that is what the details state. You may get away with it once or twice but if the brand owner (or another disgruntled seller/buyer finds you they will report you and your account will go in the end - along with that of anyone connected to you).

Edit to add, I had a very quick look and I cannot see Clarins in the Vero programme. (edited)

If goods are made for sale, then they should have no right to say what happens to it afterwards as long as the descriptions match.
Several beauty products companies engage in this practice of stifling the market

This! Happens with other products too. Some brands and retailers routinely report legitimate competition as "fakes" and eBay is happy to assist.

eBay is geared towards buyers and retailers, not private sellers.

Bozo007 that makes sense. It might be that. I'm not sure. The item is genuine. You know when they have those offers like spend £100 and get x y z free. I have no use for x y z so thought might as well shove them on eBay but it's been pulled once.

I'm sure it mentioned other brands like Azzaro and Mugler or something although I have never heard of them or listed them.

Sod it, I might try again and if it gets pulled, I will just bin the creams! I have proof of the chat and they said it was fine so unsure what the issue. I can see lots of other Clarins creams (same ones on eBay) from private sellers.

Thanks all for your help x

eBay is happy to enforce these "safety standards" when the big money demands it, but will happily let through poor quality batteries, unbranded brake pads, unknown electrical items, and other that might cause more serious problems than a couple of zits or a rash
