    Anyone who has received the handset also has their receipt (which confirms the correct price and mobile contract agreement). The terms to the contract were formed at dispatch (as stated in the terms and conditions section 8.2), so receiving the phone and the receipt binds the contract.

    It is not anyone's responsibility at this point to resolve any issues with the mobile network not being activated, that is Affordable Mobiles responsibility. If they have cancelled the mobile network agreement then they have to reinstate it, otherwise they are breaching the agreed terms that you have formed a contract on. Under no circumstances should anyone be required to contact Affordable Mobiles regarding this, they have to contact you to resolve this. The 14 days is only relevant if you are looking to cancel your agreed terms (which I'm certain everyone is happy to pay the agreed £17 p/m).

    Do not feel pressured to return the handset as they now are legally bound to their terms and conditions. If Affordable Mobiles are concerned that no network contract has started, they need to arrange to set it up (at the agreed £17 p/m as set out in the receipt). If they try to get you to agree to a different priced monthly plan in order to keep the handset, then they are breaking the contract terms you've agreed to. The contract has already been formed on the original terms, nothing they do or say will change that.

    I would go as far to say that the people who had handsets recalled before delivery, are in a position to complain that Affordable Mobiles have breached the terms of a contract that had also already been formed. Affordable Mobiles would then be liable for any loss or damage (if you took time off work for delivery etc.), as set out in their terms and conditions section 16.1 as the breach of their terms would've caused that.

    Nobody has done anything wrong by accepting delivery on an order that was placed at an agreed price, which has now been legally binded by the contract set out. The result of the issues with the mobile network is Affordable Mobiles problem, they have to resolve it not you. They have no legal grounds to request the handset back.

    Clearly you are one of the people that didn't receive a dispatch email... If no one had received dispatch emails, received phones, had phones recalled during delivery, had credit checks, network contracts started and cancelled, direct debits set up, debt threats to return devices etc. etc. So yep if this didn't happen, then yeah I'd agree... However those things have happened to lots of people. So for you it may seem fine, but look at the bigger picture in future before praising a company that don't play by the rules.

I never thought it was a pricing error and placed my order in good faith as I would do for any hold deal. There was a deal yesterday with 100gb of data with Galaxy S10e 128gb phone (rrp 750pounds) for just 25 pounds a month with three network - that deal was a legitimate directly from three network.This deal is not too way off with 17 pounds for 500mb of data with a 750 pound phone free. As a buyer I really thought that this was a legitimate deal and nothing that cried out as a 'misprice'.Affordable mobile has wasted my time with credit check, credit card charge and I now have a new account with EE and new mobile phone line and a 24 month contract (even a direct debit has been set up with my bank by EE).... U are saying that affordable mobile is not responsible for the hardship I am going through and they can get away with not sending my phone?

    Right guys, good news for me, I finally set up the phone with my ee sim I received all the usual texts about my allowance and mins and crap, the final txt was one saying we have received your request to cancel this contract and it will happen on 19th.

    I got straight on too ee was speaking too a guy and explained I don't want too cancel, I never requested a cancellation, I did a bit off ring kissing by explaining that I love ee and why would I want too cancel.

    He goes sorts it out tells me AM sent the cancellation request over, he doesn't know why they did but he has overridden it and my £17pm contract is now fully live and direct debit set up.

    Phone is fully functional, I can call, txt and use data

    BTW I played dumb and never mentioned anything about AM apart from the fact that they are who I ordered through

It doesn’t matter if the contract has been accepted, if the pricing was an obvious mistake (which it was here!) then the retailer can successfully void a contract - the law doesn’t allow you to benefit off of a mistake to a retailer’s detriment. I keep seeing people say the the retailer ‘broke the contract’ and have to enforce it, they really don’t.

    Just pay the airtime off and unlock phone. You won't pay vat on early termination so will work out cheaper.
