TERMS & CONDITIONS

We are ASOS.com Limited, a company registered in England and Wales, with registered address and HQ at Greater London House, Hampstead Road, London NW1 7FB. Our company number is 3584121.

ASOS Premier is available to UK addresses only. It gives subscribers free delivery options for a whole year including Next Day Delivery, Nominated Delivery (both subject to a minimum spend of £15 per order) and Standard Delivery (where available – see below for more details).

Your use of ASOS Premier is subject to these terms and conditions.


SUBSCRIBING TO ASOS PREMIER

You need to be a registered ASOS customer to subscribe to ASOS Premier – you can subscribe by adding it to your bag and then checking-out, or via "My Account" and then "Join ASOS Premier".

We accept the payment methods shown to you during the subscription sign-up (but if your subscription auto-renews, then buy now pay later or pay in instalment methods, such as Klarna and Clearpay, will not be available payment methods for you).

After you subscribe, you will receive an acknowledgement e-mail from us confirming your order. We only accept your order once payment has been approved (and then a contract is made based on these terms and conditions). If your subscription will automatically renew, then payment is taken via a separate page hosted by Stripe, but your contract is still with us, and made in the same way).

USING ASOS PREMIER

You must be logged in to your account to use it.

ASOS Premier is valid for 12 months from the day you sign up (or, if renewing after your subscription has expired, from the day your subscription renewal begins).

Certain ASOS Premier subscriptions also automatically renew for 12 month periods unless you cancel your subscription before your next renewal date. We will let you know, at the point of sign-up, if your subscription will automatically renew. If your subscription does automatically renew, payment will be taken automatically on or around the first day of each new subscription term.

Your subscription is locked to the UK. You can’t use ASOS Premier in another country with this subscription.

CANCELLATION

Cancelling a one-off subscription, or cancelling within the current term of your auto-renewing subscription

You can cancel ASOS Premier, provided that you have not made any eligible purchases as follows:

You can cancel within 15 minutes of ordering ASOS Premier through "My Account" by cancelling the associated ASOS order if applicable; or

Within the first calendar month of your subscription term start date by contacting Customer Care.

A full refund of your subscription fee will be given to you provided that you have not made any eligible purchases. Once an eligible purchase has been made, you will no longer be entitled to cancel and receive a refund.

Cancelling future renewals and terms of your auto-renewing subscription

If you have an auto-renewing subscription, you can cancel your subscription at any time before your next renewal date via "My Account" and "Manage Subscription", but that cancellation will only take effect from the end of current subscription term – this means that your subscription will continue for its current term, and then expire at the renewal date (instead of auto-renewing).

Legal cancellation right

You also have the right to cancel a contract within 14 days without giving any reason in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period ends 14 days after your subscription first begins. To exercise this right, you must tell us of your decision to cancel this contract by a clear statement (e.g. contacting Customer Care, letter, email).

To meet the cancellation deadline, you must tell us of your decision before the cancellation period ends.

If you cancel, we will reimburse all payments received from you – we will make the re-imbursement using the same means of payment as you initially used, unless agreed otherwise – they're won't be any charge for any reimbursement.

DELIVERY AVAILABILITY

If part of an order is shipped by ASOS EU or ASOS US - as specified at checkout, then this part of the order will be delivered via Standard Delivery. Up-to-date delivery timescales are available at checkout.

Area Restrictions:

Next-Day Delivery and Nominated Delivery are not available for the Channel Islands or these postcodes: AB31-56, BF (all), FK 17-21, HS (all), IM (all), IV (all), KA27-28, KW (all), PA20-80, PH15-50, TR21-25, ZE (all). Standard Delivery is still available with no minimum spend!

Cut-Off Times:
Orders must be made within the delivery timescales set out in checkout. Before you finalise your order, we’ll give you estimated delivery times and dates (and the delivery options available) depending on the order time and delivery address.

The standard cut-off times below are subject to change (e.g. they may be brought forward during busy periods). Up-to-date information is available at checkout.

Next-Day Delivery (where available) is on the next day if you order before 22:00 Monday to Sunday.

Northern Ireland delivery addresses: Next Day Delivery is on the next day if you order before 21:00 Monday to Friday. Orders are not despatched or delivered on Sundays. Order before 23:59 on Saturdays for delivery on Monday. Order before 23:59 on Sundays for delivery on Tuesday.

Isle of Wight delivery addresses: Next Day Delivery is on the next day if you order before 21:00 Monday to Thursday. Order before 21:00 on Friday for delivery on Monday. Next Day Deliveries are not made on Saturdays or Sundays.

DELAYS

We try our hardest to meet all delivery times, but, very occasionally, there may be delays, especially during busy periods (e.g. sale) but also because of things like postal/carrier delays, traffic delays, logistics, bad weather or if our Delivery Partners are unable to access the delivery address. We won’t be held liable for any delays or failures to comply with our obligations if the delay or failure arises from any circumstances beyond our and our Delivery Partners’ reasonable control or during periods of high volume (e.g. sale, Black Friday weekend), when delivery times may be extended. This does not affect your legal rights. We aim to keep you updated and you should be able to track your parcel’s progress. If you have any other issues, feel free to contact Customer Care.


OTHER EXCLUSIONS

Deliveries won’t be made on public holidays.

ASOS Premier can’t be used on purchases made on ASOS Marketplace.

We can't be held liable for any parcels that are lost or stolen as a result of any specific delivery instructions left for the Delivery Partner.

Certain brands may be subject to additional delivery restrictions and purchases made may not be available for Next-Day or Nominated Delivery.

ASOS Premier is unavailable on items sold and shipped by an ASOS Brand Partner.



PERSONAL USE ONLY

ASOS Premier is strictly for personal use only and must not be used for business, re-sale or wholesale purposes.


You can order (and make free returns) as many times as you want but this is subject to a fair use policy – we need to make sure people are not taking advantage of this great proposition which may include making excessive use of, or placing unusual burdens on, the service (e.g. ordering and returning beyond what would reasonably be expected of someone using the service for personal use).


TERMINATION AND SUSPENSION

We may terminate a ASOS Premier subscription at any time, will contact you at least 30 days beforehand, and you will be given a prorated refund based on the number of full months left on your subscription.

If we reasonably suspect or discover that use of ASOS Premier:

has been in serious breach of these terms and conditions; and/or

has been for business, re-sale or wholesale purposes, or for any purpose other than can be reasonably expected of someone using the service for personal use; and/or
involves fraud or misuse or is otherwise detrimental to ASOS’ interests,

we may immediately suspend or terminate a ASOS Premier subscription (and a refund will not be given), refuse or cancel order(s) or close or freeze the ASOS customer account (and associated accounts) (even if we have previously confirmed an order).

We’ll try to contact you if this happens, but if this happens to you and you think we’ve made a mistake, please don’t take offence – get in touch with Customer Care and they’ll be happy to speak to you about it.

If we suspect or discover that a ASOS Premier subscription has been used in serious breach of these terms and conditions, we have the right to recoup all our direct delivery costs and losses from the account holder.



CHANGES TO MINIMUM THRESHOLDS

We may change, or introduce, any minimum spend threshold from time to time. We will give you at least 30 days' notice of any minimum threshold changes before they come into effect. If you do not want to continue your subscription with the new minimum threshold, you can terminate it at any time before the new threshold takes effect, and you will be given a prorated refund based on the number of full months left on your subscription.



CHANGES TO SUBSCRIPTION PRICES

We may change the price of our ASOS Premier subscription from time to time. We will give you at least 30 days' notice of any price changes, and these will not come into effect during your current subscription term, and will only apply on renewal or auto-renewal. If you do not want to continue your subscription at the new price, you can let it expire, or, if you have an auto-renewing subscription, you can cancel it before the start of the next subscription term.



CHANGES TO TS&CS

We have the right to change these terms and conditions at any time for the following reasons - to improve them, or make them clearer or easier to understand; to comply with legal or regulatory requirements; to provide you with additional information about the subscription; if we make changes to the subscription; where we reorganise the way we run our business; or for security reasons.

As we provide the subscription on an ongoing basis, we also can't foresee what may change in the future. This means we may make changes or additions to these terms and conditions for reasons other than those above, as long as they are reasonable.

If we change these terms and conditions in a way that will impact your legal rights or obligations, where possible we will notify you and give you the opportunity to read the new terms before the changes take effect (unless a change needs to be implemented quickly to reflect a sudden change).

If we reasonably think that a change will disadvantage you, we will give you at least 30 days' notice of the change. If you do not want to continue your subscription on the amended terms and conditions, you can terminate it at any time before the change takes effect, and you will be given a prorated refund based on the number of full months left on your subscription.



LEGAL STUFF

These terms and conditions are subject to English law and the exclusive jurisdiction of the English courts. These terms and conditions are between ASOS.com Limited and you, and any communications between ASOS.com Limited and you, will in English.
