Paypal claim against Dominos

Posted 1st Nov 2023
Had a crap week so far, decided to indulge in a mid-week pizza. Paid £20+ for pizza, sides, 1.25l drink at dominos and paid an extra £2.50 I think it was for delivery as I can't drive at the moment due to medical issues.

Pizza turns up. No drink. I ask the driver "do you have my bottle of coke?" and he says: "Oh . Sorry I'll go get it!"

30 minutes later, he comes back with a 500ml bottle. "I don't mean to be awkward," I said, "but I ordered a 1.25l bottle..." to which he replied: "Oh right mate you just said a bottle. Can't go back now, store is closing. Cya buddy!" and headed off back to his car and drove off at the speed of light.

I didn't want to be petty, but at the same time when you've paid almost £30 for food+delivery, at the very least it should be the right order?!

So I raised a paypal claim and paypal refunded me instantly. This is where I'm a bit paranoid. The email I got said: "case closed" - but when I go into paypal, the money is in my account, but it says case under review.

Is there any chance dominos will fight this claim? If they do, I've got my doorcam footage of the entire thing, so I'm not fussed. But it's a battle I can do without. I just wanted my 1.25l drink lol

The difference between the 1.25L and 500ml drinks is £1. Yes its not great that they messed up your order, but I would have called the store next day and just got a note to add it onto the next delivery along with an extra freebie or something.

If PayPal have refunded the entire order then you have obtained the food for free which seems wrong. (edited)

you should have stated, do you have my 1.25ml bottle..

people saying you deserve the full £30 refund, are just wrong, I do hope it is reversed, minus the £1 for the drink..

if it’s this easy to get a PayPal refund, I know how I’m paying for my next takeaway

Was there any reason you couldn't call Dominos the next day? I usually have PayPal / charge back as a backup plan because there is nothing convenient left after that.

In the future it's best to simply contact the store and let them resolve the issue. If you don't want to contact the store directly, then raise a complaint through their social media channels with DM, and they will get the store to resolve it for you. You will almost always receive a freebie to compensate for their error. Escalating the issue to PayPal seems a bit too far, especially when it is clearly a simple error on their behalf.

What's the worst that can happen? Domino's deservedly getting their money back and you being out 750ml of coke. Don't stress.

Yikes - if full refund I wouldn't be comfortable with that. I'd be heading there to pay them for the food they made and I ate. Wonderful world - we're all different

How much did PayPal refund you?

I agree, you did not get what you ordered. I understand when people say it is not worth the hassle but I think it is, too many companies get away with the small things. If you paid for goods or services then you are entitled to those goods/services no matter how small or what cost.

Obviously it is up to the individual how far they want to take it and whether they consider it is worth the stress for them.

So you think it's fair that the entire £30 was refunded, not just the coke?

Paypal are usually very much in favour of the customer so you've a pretty good chance of winning.

Just a note that a chargeback to Paypal via your bank would almost certainly result in you getting banned and also causes them sometimes to send you letters threatening legal action against you.

Doesn't seem right they should lose total cost because of a mix up, probably banned now anyway, I wouldn't like to guess what could be added extra to my pizza next time anyway (edited)

I've never heard of Paypal refunding before the conclusion of a case so I'd assume you are safe. Don't stress over it, it isn't worth it over a bottle of coke.

You didn't get what you paid for, so I'd say you were in the right.
