Used car from dealership faulty, rights?

Posted 26th Apr 2023
Hi all, am wondering what our rights our regarding a used car bought from a main dealership.
It was purchased by a disabled housebound man for an 82 year old woman. He managed to get out to pay for it but, hasn't been able to get to the garage when it's been taken back to "fix" due to not having enough oxygen for longer time out the house.

It was purchased just over 4 weeks ago now but, only after two weeks it was in all-day for an intermittent fault they couldn't find. Last week, 4 weeks after owning it lights appeared on the dash again and this time stayed on. When asked about swapping it for another car, he was told he'd only get the part ex price, despite it not being the 30 days as per Consumer Law.
They've now had the car for a week and is being sent to another "Drive" garage nearby as this "Drive" haven't been able to fix it.

A car was part-exed for this new car, with £5-6k added on top to get it. Where do we stand, as I feel they're just messing them about now.
He did purchase the extra 2yr warranty as well but, with this fault presenting before the 30 days were up it should be sorted under this. She doesn't trust the car now and is unlikely to enjoy it the same as when she first got it. So just trying to gather some information on how they can proceed.

Insist that the car is returned as not fit for purpose - take it as high up the chain of command as you can!

Reject the car and don't let them get away with any nonsense about buying it back at part ex price. That's illegal. Reject the car as not fit for purpose and demand a full refund. If they kick up a fuss, take it as high as possible. If the company still refuse. Take it to trading standards and the motor ombudusman.

Check house insurance as that often has legal advice built in. They will at least advise you and in some cases represent you, depending on the policy.

Was it financed (HP) or cash payment (including using a separate loan)?

No HP, just paid straight from his current account card

Just out of interest, how old is the new car? What make/model is it?

What warning light has come on?

You could contact Citizens Advice to see what your rights are. (edited)

Its an 18 reg Nissan Juke
One of them was the engine light, they've diagnosed it as being the injection boosters that are faulty on the first day they had it. (edited)

I'd call dean Dunham on lbc Friday evening. He'll explain your rights under the consumer rights act 15 after he's got over that a credit card wasn't used. (edited)
